66 AN ACT
77 relating to faculty temporary licenses to practice medicine.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 155.104(b), (e), (g), and (h),
1010 Occupations Code, are amended to read as follows:
1111 (b) The board may issue a faculty temporary license to
1212 practice medicine to a physician [appointed by a medical school in
1313 this state] as provided by this section. The physician:
1414 (1) must hold a current medical license that is
1515 unrestricted and not subject to a disciplinary order or probation
1616 in another state or a Canadian province or have completed at least
1717 three years of postgraduate residency;
1818 (2) may not hold a medical license in another state or
1919 a Canadian province that has any restrictions, disciplinary orders,
2020 or probation;
2121 (3) must pass the Texas medical jurisprudence
2222 examination; and
2323 (4) must hold a salaried faculty position equivalent
2424 to [of] at least the level of assistant professor and be working
2525 full-time at one of the following institutions:
2626 (A) The University of Texas Medical Branch at
2727 Galveston;
2828 (B) The University of Texas Southwestern Medical
2929 Center at Dallas;
3030 (C) The University of Texas Health Science Center
3131 at Houston;
3232 (D) The University of Texas Health Science Center
3333 at San Antonio;
3434 (E) The University of Texas Health Center at
3535 Tyler;
3636 (F) The University of Texas M. D. Anderson Cancer
3737 Center;
3838 (G) Texas A&M University College of Medicine;
3939 (H) Texas Tech University School of Medicine;
4040 (I) Baylor College of Medicine; [or]
4141 (J) the University of North Texas Health Science
4242 Center at Fort Worth;
4343 (K) an institutional sponsor of a graduate
4444 medical education program accredited by the Accreditation Council
4545 for Graduate Medical Education; or
4646 (L) a nonprofit health corporation certified
4747 under Section 162.001 and affiliated with a program described by
4848 Paragraph (K).
4949 (e) A physician holding a temporary license under
5050 Subsection (b) and the physician's institution [medical school]
5151 must file affidavits with the board affirming acceptance of the
5252 terms and limits imposed by the board on the medical activities of
5353 the physician.
5454 (g) The holder of a temporary license issued under
5555 Subsection (b) is limited to the teaching confines of the applying
5656 institution [medical school] as a part of the physician's duties
5757 and responsibilities assigned by the institution [school] and may
5858 not practice medicine outside of the setting of the institution
5959 [medical school] or an affiliate of the institution [medical
6060 school]. The physician may participate in the full activities of
6161 the department of any hospital for which the physician's
6262 institution [medical school] has full responsibility for clinical,
6363 patient care, and teaching activities.
6464 (h) The application for a temporary license under
6565 Subsection (b) must be made by the chairman of the department of the
6666 institution [medical school] in which the physician teaches, or the
6767 person holding the equivalent position at the institution where the
6868 physician teaches, and must contain the information and
6969 documentation requested by the department. The application must be
7070 endorsed by the dean of the medical school or the president of the
7171 institution.
7272 SECTION 2. This Act takes effect immediately if it receives
7373 a vote of two-thirds of all the members elected to each house, as
7474 provided by Section 39, Article III, Texas Constitution. If this
7575 Act does not receive the vote necessary for immediate effect, this
7676 Act takes effect September 1, 2009.
