8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 172.116(b), Election Code, is amended to | |
10 | 10 | read as follows: | |
11 | 11 | (b) The committee shall convene to conduct the local canvass | |
12 | 12 | at the county seat [not earlier than 6 p.m.] on the second Thursday | |
13 | 13 | [or later than 1 p.m. on the second Friday] after election day at | |
14 | 14 | the hour specified by the county chair. | |
15 | 15 | SECTION 2. Section 172.120, Election Code, is amended by | |
16 | 16 | amending Subsection (b) and adding Subsection (b-1) to read as | |
17 | 17 | follows: | |
18 | 18 | (b) The state executive committee shall convene to conduct | |
19 | 19 | the state canvass for the general primary election not later than: | |
20 | 20 | (1) [on] the second Sunday [Wednesday] after general | |
21 | 21 | primary election day, for an election in which three or more | |
22 | 22 | candidates are seeking election to the same office; or | |
23 | 23 | (2) the 22nd day after general primary election day, | |
24 | 24 | for an election not described by Subdivision (1). | |
25 | 25 | (b-1) Not later than the third [second] Saturday after | |
26 | 26 | runoff primary election day, the committee shall convene at the | |
27 | 27 | call of the state chair to conduct the state canvass of the runoff | |
28 | 28 | primary election. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2009. |
