66 AN ACT
77 relating to the confidentiality under the public information law of
88 certain name and address information provided to a governmental
99 body.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1212 amended by adding Section 552.1375 to read as follows:
1313 Sec. 552.1375. CONFIDENTIALITY OF CERTAIN NAME AND ADDRESS
1414 INFORMATION. (a) Except as otherwise provided by this section, the
1515 name and physical address of an individual who provides that
1616 information to a governmental body in connection with a
1717 communication to the governmental body or for the purpose of
1818 receiving a subsequent communication from the governmental body is
1919 confidential and not subject to disclosure under this chapter.
2020 (b) Confidential information described by Subsection (a)
2121 may be disclosed if the individual affirmatively consents to its
2222 release.
2323 (c) Subsection (a) does not apply to the name or address of
2424 an individual that was provided for a purpose or in a manner
2525 described by Section 552.137(c).
2626 (d) Subsection (a) does not prevent a governmental body from
2727 disclosing confidential information described by Subsection (a)
2828 for any reason to another governmental body or to a federal agency.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
