| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 552, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 552.1375 to read as follows: |
|---|
| 13 | 13 | | Sec. 552.1375. CONFIDENTIALITY OF CERTAIN NAME AND ADDRESS |
|---|
| 14 | 14 | | INFORMATION. (a) Except as otherwise provided by this section, the |
|---|
| 15 | 15 | | name and physical address of an individual who provides that |
|---|
| 16 | 16 | | information to a governmental body in connection with a |
|---|
| 17 | 17 | | communication to the governmental body or for the purpose of |
|---|
| 18 | 18 | | receiving a subsequent communication from the governmental body is |
|---|
| 19 | 19 | | confidential and not subject to disclosure under this chapter. |
|---|
| 20 | 20 | | (b) Confidential information described by Subsection (a) |
|---|
| 21 | 21 | | may be disclosed if the individual affirmatively consents to its |
|---|
| 22 | 22 | | release. |
|---|
| 23 | 23 | | (c) Subsection (a) does not apply to the name or address of |
|---|
| 24 | 24 | | an individual that was provided for a purpose or in a manner |
|---|
| 25 | 25 | | described by Section 552.137(c). |
|---|
| 26 | 26 | | (d) Subsection (a) does not prevent a governmental body from |
|---|
| 27 | 27 | | disclosing confidential information described by Subsection (a) |
|---|
| 28 | 28 | | for any reason to another governmental body or to a federal agency. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2009. |
