| 7 | 7 | relating to the deadlines for commencement and completion of the | |
| 8 | 8 | Lake Columbia reservoir project. | |
| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. The legislature finds that the proposed Lake | |
| 11 | 11 | Columbia project authorized by Permit to Appropriate State Water | |
| 12 | 12 | Number 4228 (Application No. 4537) is a rural water project for | |
| 13 | 13 | political subdivisions and that its construction and development | |
| 14 | 14 | are in the public interest. The legislature further finds that the | |
| 15 | 15 | Texas Water Development Board has obtained a right and interest in | |
| 16 | 16 | the permit and that the deadlines provided by the permit for | |
| 17 | 17 | commencement and completion of construction of the project should | |
| 18 | 18 | be stricken from the permit. | |
| 19 | 19 | SECTION 2. The Texas Commission on Environmental Quality | |
| 20 | 20 | shall issue without notice or hearing an amendment to the permit | |
| 21 | 21 | striking from the permit the deadlines provided by the permit for | |
| 22 | 22 | commencement and completion of construction of the project in | |
| 23 | 23 | accordance with this Act. | |
| 24 | 24 | SECTION 3. This Act takes effect immediately if it receives | |
| 25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
| 26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
| 27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
| 28 | 28 | Act takes effect September 1, 2009. |
