44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to supplemental benefits to certain annuitants of the
77 Employees Retirement System of Texas.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 814, Government Code is amended by
1010 adding Section 814.6031 to read as follows:
1111 Sec. 814.6031 SUPPLEMENTAL PAYMENTS IN CERTAIN FISCAL
1212 YEARS. Notwithstanding any other provision of law to the contrary,
1313 the retirement system shall make a supplemental payment to a person
1414 whose annuities are described by Section 814.107, 814.207, 814.305,
1515 or 814.601(a) and that are based on service retirements, disability
1616 retirements or deaths in each of the state fiscal years ending
1717 August 31, 2010, and August 31, 2011. The supplemental payment paid
1818 under this section shall be equal to one-twelfth of the amount paid
1919 to a person for that fiscal year.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2009.
