| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 61.003, Labor Code, is amended to read as |
|---|
| 10 | 10 | | follows: |
|---|
| 11 | 11 | | Sec. 61.003. GOVERNMENTAL ENTITIES GENERALLY EXCLUDED; |
|---|
| 12 | 12 | | EXCEPTION. (a) Except as provided by Subsection (b), this [This] |

| 13 | 13 | | chapter does not apply to the United States, this state, or a |
|---|
| 14 | 14 | | political subdivision of this state. |
|---|
| 15 | 15 | | (b) Subchapters A, B, and D apply to a school district. |
|---|
| 16 | 16 | | SECTION 2. Subchapter A, Chapter 61, Labor Code, is amended |
|---|
| 17 | 17 | | by adding Section 61.0035 to read as follows: |
|---|
| 18 | 18 | | Sec. 61.0035. WAIVER OF IMMUNITY FOR SCHOOL DISTRICTS. A |
|---|
| 19 | 19 | | school district employee who alleges a violation of this chapter |
|---|
| 20 | 20 | | may sue the employing school district for the relief provided by |
|---|
| 21 | 21 | | this chapter. Sovereign immunity is waived and abolished to the |
|---|
| 22 | 22 | | extent of liability for the relief allowed under this chapter for a |
|---|
| 23 | 23 | | violation of this chapter. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2009. |
