| 7 | 7 | | relating to the transfer of service credits to or from the elected |

| 8 | 8 | | class in the Employees Retirement System of Texas. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 813.503(a), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) A member may establish in, or have transferred to, the |
|---|
| 13 | 13 | | employee class all service credited in the elected class, if the |
|---|
| 14 | 14 | | contributions made to establish the service in the elected class |
|---|
| 15 | 15 | | equal or exceed contributions required of a member of the employee |
|---|
| 16 | 16 | | class for the same amount of service during the same time and at the |
|---|
| 17 | 17 | | same rate of compensation. The member before retirement may |
|---|
| 18 | 18 | | transfer the service credit back to the elected class. [A member or |
|---|
| 19 | 19 | | retiree who has, or had at the time of retirement, at least eight |
|---|
| 20 | 20 | | years of service credit in the elected class of membership, |
|---|
| 21 | 21 | | exclusive of military service, may transfer service credit between |
|---|
| 22 | 22 | | classes before or after retirement.] |

| 23 | 23 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 24 | 24 | | 813.503(a), Government Code, applies only to service credit for |
|---|
| 25 | 25 | | which a notification of transfer is made to the Employees |
|---|
| 26 | 26 | | Retirement System of Texas on or after the effective date of this |
|---|
| 27 | 27 | | Act. Service credit for which a notification of transfer is made |
|---|
| 28 | 28 | | under Section 813.503(a), Government Code, before that date is |
|---|
| 29 | 29 | | subject to the law in effect at the time the notification is made, |
|---|
| 30 | 30 | | and the former law is continued in effect for that purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect August 1, 2009, if it |
|---|
| 32 | 32 | | receives a vote of two-thirds of all the members elected to each |
|---|
| 33 | 33 | | house, as provided by Section 39, Article III, Texas Constitution. |
|---|
| 34 | 34 | | If this Act does not receive the vote necessary for effect on that |
|---|
| 35 | 35 | | date, this Act takes effect September 1, 2009. |
