55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the transfer of service credits to or from the elected
88 class in the Employees Retirement System of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 813.503(a), Government Code, is amended
1111 to read as follows:
1212 (a) A member may establish in, or have transferred to, the
1313 employee class all service credited in the elected class, if the
1414 contributions made to establish the service in the elected class
1515 equal or exceed contributions required of a member of the employee
1616 class for the same amount of service during the same time and at the
1717 same rate of compensation. The member before retirement may
1818 transfer the service credit back to the elected class. [A member or
1919 retiree who has, or had at the time of retirement, at least eight
2020 years of service credit in the elected class of membership,
2121 exclusive of military service, may transfer service credit between
2222 classes before or after retirement.]
2323 SECTION 2. The change in law made by this Act to Section
2424 813.503(a), Government Code, applies only to service credit for
2525 which a notification of transfer is made to the Employees
2626 Retirement System of Texas on or after the effective date of this
2727 Act. Service credit for which a notification of transfer is made
2828 under Section 813.503(a), Government Code, before that date is
2929 subject to the law in effect at the time the notification is made,
3030 and the former law is continued in effect for that purpose.
3131 SECTION 3. This Act takes effect August 1, 2009, if it
3232 receives a vote of two-thirds of all the members elected to each
3333 house, as provided by Section 39, Article III, Texas Constitution.
3434 If this Act does not receive the vote necessary for effect on that
3535 date, this Act takes effect September 1, 2009.
