99 relating to the creation of the Fort Bend County Municipal Utility
1010 District No. 192; providing authority to impose a tax and issue
1111 bonds; granting a limited power of eminent domain.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1414 Code, is amended by adding Chapter 8330 to read as follows:
1515 CHAPTER 8330. FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 192
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 8330.001. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "Director" means a board member.
2020 (3) "District" means the Fort Bend County Municipal
2121 Utility District No. 192.
2222 Sec. 8330.002. NATURE OF DISTRICT. The district is a
2323 municipal utility district created under Section 59, Article XVI,
2424 Texas Constitution.
2525 Sec. 8330.003. CONFIRMATION AND DIRECTORS' ELECTION
2626 REQUIRED. The temporary directors shall hold an election to
2727 confirm the creation of the district and to elect five permanent
2828 directors as provided by Section 49.102, Water Code.
2929 Sec. 8330.004. CONSENT OF MUNICIPALITY REQUIRED. (a) The
3030 temporary directors may not hold an election under Section 8330.003
3131 until each municipality in whose corporate limits or
3232 extraterritorial jurisdiction the district is located has
3333 consented by ordinance or resolution to the creation of the
3434 district and to the inclusion of land in the district.
3535 (b) Subject to the limitations of Section 54.016, Water
3636 Code, the district shall comply with all applicable requirements of
3737 any ordinance or resolution adopted by the governing body of the
3838 municipality that consents to the creation of the district or to the
3939 inclusion of lands within the district.
4040 (c) In addition to the restrictions and conditions
4141 described by Section 54.016(e), Water Code, a municipality that
4242 contains district territory in its corporate limits or
4343 extraterritorial jurisdiction may include in the municipality's
4444 consent any restriction on or condition to the municipality's
4545 consent to the creation of the district, including a limitation on
4646 the powers of the district otherwise granted by this chapter.
4747 Sec. 8330.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4848 The district is created to serve a public purpose and benefit.
4949 (b) The district is created to accomplish the purposes of:
5050 (1) a municipal utility district as provided by
5151 general law and Section 59, Article XVI, Texas Constitution; and
5252 (2) Section 52, Article III, Texas Constitution, that
5353 relate to the construction, acquisition, or improvement of
5454 macadamized, graveled, or paved roads described by Section 54.234,
5555 Water Code, or improvements, including storm drainage, in aid of
5656 those roads.
5757 Sec. 8330.006. INITIAL DISTRICT TERRITORY. (a) The
5858 district is initially composed of the territory described by
5959 Section 2 of the Act creating this chapter.
6060 (b) The boundaries and field notes contained in Section 2 of
6161 the Act creating this chapter form a closure. A mistake made in the
6262 field notes or in copying the field notes in the legislative process
6363 does not affect the district's:
6464 (1) organization, existence, or validity;
6565 (2) right to issue any type of bond for the purposes
6666 for which the district is created or to pay the principal of and
6767 interest on a bond;
6868 (3) right to impose a tax; or
6969 (4) legality or operation.

7171 SUBCHAPTER B. BOARD OF DIRECTORS
7272 Sec. 8330.051. GOVERNING BODY; TERMS. (a) The district is
7373 governed by a board of five elected directors.
7474 (b) Except as provided by Section 8330.052, directors serve
7575 staggered four-year terms.
7676 Sec. 8330.052. TEMPORARY DIRECTORS. (a) On or after the
7777 effective date of the Act creating this chapter, the owner or owners
7878 of a majority of the assessed value of the real property in the
7979 district may submit a petition to the Texas Commission on
8080 Environmental Quality requesting that the commission appoint as
8181 temporary directors the five persons named in the petition. The
8282 commission shall appoint as temporary directors the five persons
8383 named in the petition.
8484 (b) Temporary directors serve until the earlier of:
8585 (1) the date permanent directors are elected under
8686 Section 8330.003; or
8787 (2) the fourth anniversary of the effective date of
8888 the Act creating this chapter.
8989 (c) If permanent directors have not been elected under
9090 Section 8330.003 and the terms of the temporary directors have
9191 expired, successor temporary directors shall be appointed or
9292 reappointed as provided by Subsection (d) to serve terms that
9393 expire on the earlier of:
9494 (1) the date permanent directors are elected under
9595 Section 8330.003; or
9696 (2) the fourth anniversary of the date of the
9797 appointment or reappointment.
9898 (d) If Subsection (c) applies, the owner or owners of a
9999 majority of the assessed value of the real property in the district
100100 may submit a petition to the commission requesting that the
101101 commission appoint as successor temporary directors the five
102102 persons named in the petition. The commission shall appoint as
103103 successor temporary directors the five persons named in the
104104 petition.

106106 SUBCHAPTER C. POWERS AND DUTIES
107107 Sec. 8330.101. GENERAL POWERS AND DUTIES. The district has
108108 the powers and duties necessary to accomplish the purposes for
109109 which the district is created.
110110 Sec. 8330.102. MUNICIPAL UTILITY DISTRICT POWERS AND
111111 DUTIES. The district has the powers and duties provided by the
112112 general law of this state, including Chapters 49 and 54, Water Code,
113113 applicable to municipal utility districts created under Section 59,
114114 Article XVI, Texas Constitution.
115115 Sec. 8330.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
116116 Section 52, Article III, Texas Constitution, the district may
117117 design, acquire, construct, finance, issue bonds for, improve, and
118118 convey to this state, a county, or a municipality for operation and
119119 maintenance macadamized, graveled, or paved roads described by
120120 Section 54.234, Water Code, or improvements, including storm
121121 drainage, in aid of those roads.
122122 (b) The district may exercise the powers provided by this
123123 section without submitting a petition to or obtaining approval from
124124 the Texas Commission on Environmental Quality as required by
125125 Section 54.234, Water Code.
126126 Sec. 8330.104. APPROVAL OF ROAD PROJECT. (a) The district
127127 may not undertake a road project authorized by Section 8330.103
128128 unless:
129129 (1) each municipality or county that will operate and
130130 maintain the road has approved the plans and specifications of the
131131 road project, if a municipality or county will operate and maintain
132132 the road; or
133133 (2) the Texas Transportation Commission has approved
134134 the plans and specifications of the road project, if the state will
135135 operate and maintain the road.
136136 (b) Except as provided by Subsection (a), the district is
137137 not required to obtain approval from the Texas Transportation
138138 Commission to design, acquire, construct, finance, issue bonds for,
139139 improve, or convey a road project.
140140 Sec. 8330.105. LIMITATION ON USE OF EMINENT DOMAIN. The
141141 district may not exercise the power of eminent domain outside the
142142 district to acquire a site or easement for:
143143 (1) a road project authorized by Section 8330.103; or
144144 (2) a recreational facility as defined by Section
145145 49.462, Water Code.

147147 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
148148 Sec. 8330.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
149149 district may issue, without an election, bonds and other
150150 obligations secured by:
151151 (1) revenue other than ad valorem taxes; or
152152 (2) contract payments described by Section 8330.153.
153153 (b) The district must hold an election in the manner
154154 provided by Chapters 49 and 54, Water Code, to obtain voter approval
155155 before the district may impose an ad valorem tax or issue bonds
156156 payable from ad valorem taxes.
157157 (c) The district may not issue bonds payable from ad valorem
158158 taxes to finance a road project unless the issuance is approved by a
159159 vote of a two-thirds majority of the district voters voting at an
160160 election held for that purpose.
161161 Sec. 8330.152. OPERATION AND MAINTENANCE TAX. (a) If
162162 authorized at an election held under Section 8330.151, the district
163163 may impose an operation and maintenance tax on taxable property in
164164 the district in accordance with Section 49.107, Water Code.
165165 (b) The board shall determine the tax rate. The rate may not
166166 exceed the rate approved at the election.
167167 Sec. 8330.153. CONTRACT TAXES. (a) In accordance with
168168 Section 49.108, Water Code, the district may impose a tax other than
169169 an operation and maintenance tax and use the revenue derived from
170170 the tax to make payments under a contract after the provisions of
171171 the contract have been approved by a majority of the district voters
172172 voting at an election held for that purpose.
173173 (b) A contract approved by the district voters may contain a
174174 provision stating that the contract may be modified or amended by
175175 the board without further voter approval.

177177 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
178178 Sec. 8330.201. AUTHORITY TO ISSUE BONDS AND OTHER
179179 OBLIGATIONS. The district may issue bonds or other obligations
180180 payable wholly or partly from ad valorem taxes, impact fees,
181181 revenue, contract payments, grants, or other district money, or any
182182 combination of those sources, to pay for any authorized district
183183 purpose.
184184 Sec. 8330.202. TAXES FOR BONDS. At the time the district
185185 issues bonds payable wholly or partly from ad valorem taxes, the
186186 board shall provide for the annual imposition of a continuing
187187 direct ad valorem tax, without limit as to rate or amount, while all
188188 or part of the bonds are outstanding as required and in the manner
189189 provided by Sections 54.601 and 54.602, Water Code.
190190 Sec. 8330.203. BONDS FOR ROAD PROJECTS. At the time of
191191 issuance, the total principal amount of bonds or other obligations
192192 issued or incurred to finance road projects and payable from ad
193193 valorem taxes may not exceed one-fourth of the assessed value of the
194194 real property in the district.
195195 SECTION 2. The Fort Bend County Municipal Utility District
196196 No. 192 initially includes all the territory contained in the
197197 following area:
198198 TRACT I
199199 Being a 37.73-acre (1,643,604 square feet) tract of land
200200 situated in the Abner Kuykendall League, A-48, Fort Bend County,
201201 Texas, and being portion of a called 53.9470-acre tract of land
202202 designated Tract "A" as recorded under File Number 9725698, Fort
203203 Bend County Official Records (F.B.C.O.R.). Said 37.73-acre tract
204204 of land being more particularly described by metes and bounds as
205205 follows, with all bearings referenced to the Texas Coordinate
206206 System of 1983, South Central Zone. All distances are surface based
207207 on the surface coordinates (X = 3,038,374.04, Y = 13,790,244.28) of
208208 N.G.S. Control Monument "HGCSD 70" 1983 adjustment:
209209 BEGINNING at a 3-inch by 4-inch iron bar found marking the
210210 northerly right-of-way line of Thompson Road (F.M. 762)(100 feet
211211 wide) and the westerly line of the C.I. McFarlane called 2.2-acre
212212 tract as recorded under Volume 126, Page 197 of the Fort Bend County
213213 Deed Records (F.B.C.D.R.), also being the most southerly southwest

504504 SECTION 3. (a) The legal notice of the intention to
505505 introduce this Act, setting forth the general substance of this
506506 Act, has been published as provided by law, and the notice and a
507507 copy of this Act have been furnished to all persons, agencies,
508508 officials, or entities to which they are required to be furnished
509509 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
510510 Government Code.
511511 (b) The governor, one of the required recipients, has
512512 submitted the notice and Act to the Texas Commission on
513513 Environmental Quality.
514514 (c) The Texas Commission on Environmental Quality has filed
515515 its recommendations relating to this Act with the governor, the
516516 lieutenant governor, and the speaker of the house of
517517 representatives within the required time.
518518 (d) All requirements of the constitution and laws of this
519519 state and the rules and procedures of the legislature with respect
520520 to the notice, introduction, and passage of this Act are fulfilled
521521 and accomplished.
522522 SECTION 4. This Act takes effect immediately if it receives
523523 a vote of two-thirds of all the members elected to each house, as
524524 provided by Section 39, Article III, Texas Constitution. If this
525525 Act does not receive the vote necessary for immediate effect, this
526526 Act takes effect September 1, 2009.
