55 relating to regulations regarding the sale of plastic bulk
66 merchandise containers; providing a criminal penalty.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 35.63, Business & Commerce Code, as
99 added by Chapter 307 (H.B. 1871), Acts of the 80th Legislature,
1010 Regular Session, 2007, is amended by amending Subsections (b), (c),
1111 (d), and (e) and adding Subsections (g) and (h) to read as follows:
1212 (b) A person who is in the business of recycling, shredding,
1313 or destroying plastic bulk merchandise containers, before
1414 purchasing 10 [five] or more plastic bulk merchandise containers
1515 from an individual at one time, [the same person,] shall:
1616 (1) obtain from an individual [that person]:
1717 (A) proof of ownership for the containers; and
1818 (B) a record that contains:
1919 (i) the name, address, and telephone number
2020 of the person or the person's authorized representative;
2121 (ii) the name and address of the buyer of
2222 the containers or any consignee of the containers;
2323 (iii) a description of the containers,
2424 including the number of the containers to be sold; and
2525 (iv) the date of the transaction; and
2626 (2) verify the identity of the individual selling the
2727 containers or representing the seller from a driver's license or
2828 other government-issued identification card that includes the
2929 individual's photograph, and record the verification.
3030 (c) A person who is in the business of recycling, shredding,
3131 or destroying plastic bulk merchandise containers shall retain a
3232 record obtained or made under this section until the first
3333 anniversary of the later of the date the containers are purchased or
3434 delivered.
3535 (d) A person who is in the business of recycling, shredding,
3636 or destroying plastic bulk merchandise containers who violates
3737 Subsection (b) or (c) is liable to this state for a civil penalty of
3838 $10,000 for each violation.
3939 (e) A person who is in the business of recycling, shredding,
4040 or destroying plastic bulk merchandise containers may not use an
4141 artifice to avoid the application of this section, including
4242 documenting purchases from the same person on the same day as
4343 multiple transactions. A person who is in the business of
4444 recycling, shredding, or destroying plastic bulk merchandise
4545 containers who violates this subsection is liable to this state for
4646 a civil penalty of $30,000 for each violation.
4747 (g) A person who is in the business of recycling, shredding,
4848 or destroying plastic bulk merchandise containers who violates this
4949 section commits an offense. Except as provided by Subsection (h),
5050 an offense under this subsection is a Class C misdemeanor
5151 punishable by:
5252 (1) a fine not to exceed $350, if the total purchase
5353 price of the plastic bulk merchandise containers to which the
5454 offense relates is less than $1,000; or
5555 (2) a fine not to exceed $700, if the total purchase
5656 price of the plastic bulk merchandise containers to which the
5757 offense relates is $1,000 or more.
5858 (h) If it is shown on the trial of an offense under this
5959 section that the defendant has been previously convicted of an
6060 offense under this section based on the same type of violation, the
6161 offense is punishable by a fine not to exceed twice the maximum
6262 amount of the fine prescribed for a first offense under this
6363 section.
6464 SECTION 2. Chapter 204, Business & Commerce Code, as
6565 effective September 1, 2009, is amended by adding Section 204.005
6666 to read as follows:
6767 Sec. 204.005. CRIMINAL PENALTY. (a) A person who is in the
6868 business of recycling, shredding, or destroying plastic bulk
6969 merchandise containers who violates this chapter commits an
7070 offense.
7171 (b) Except as provided by Subsection (c), an offense under
7272 this section is a Class C misdemeanor punishable by:
7373 (1) a fine not to exceed $350, if the total purchase
7474 price of the plastic bulk merchandise containers to which the
7575 offense relates is less than $1,000; or
7676 (2) a fine not to exceed $700, if the total purchase
7777 price of the plastic bulk merchandise containers to which the
7878 offense relates is $1,000 or more.
7979 (c) If it is shown on the trial of an offense under this
8080 section that the defendant has been previously convicted of an
8181 offense under this section based on the same type of violation, the
8282 offense is punishable by a fine not to exceed twice the maximum
8383 amount of the fine prescribed for a first offense under this
8484 section.
8585 SECTION 3. (a) Section 1 of this Act takes effect only if
8686 the Act of the 81st Legislature, Regular Session, 2009, relating to
8787 nonsubstantive additions to and corrections in existing codes does
8888 not become law.
8989 (b) Section 2 of this Act takes effect only if the Act of the
9090 81st Legislature, Regular Session, 2009, relating to
9191 nonsubstantive additions to and corrections in existing codes
9292 becomes law.
9393 SECTION 4. This Act takes effect September 1, 2009.
