55 relating to the enforcement of regulations regarding the sale of
66 plastic bulk merchandise containers.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 35.63, Business & Commerce Code, as
99 added by Chapter 307, Acts of the 80th Legislature, Regular
1010 Session, 2007, is amended by amending Subsection (f) and adding
1111 Subsection (g) to read as follows:
1212 (f) The attorney general or appropriate prosecuting
1313 attorney may:
1414 (1) investigate an alleged violation of this section;
1515 and
1616 (2) sue to collect a civil penalty under this section.
1717 (g) The attorney general or appropriate prosecuting
1818 attorney may recover reasonable expenses, including court costs,
1919 attorney's fees, investigative costs, witness fees, and deposition
2020 expenses, incurred in recovering a civil penalty under this
2121 section.
2222 SECTION 2. Section 204.004, Business & Commerce Code, as
2323 effective September 1, 2009, is amended to read as follows:
2424 Sec. 204.004. INVESTIGATIVE AND ENFORCEMENT AUTHORITY [OF
2525 CIVIL PENALTY]. (a) The attorney general or appropriate
2626 prosecuting attorney may:
2727 (1) investigate an alleged violation of this chapter;
2828 and
2929 (2) sue to collect a civil penalty under this chapter.
3030 (b) The attorney general or appropriate prosecuting
3131 attorney may recover reasonable expenses, including court costs,
3232 attorney's fees, investigative costs, witness fees, and deposition
3333 expenses, incurred in recovering a civil penalty under this
3434 section.
3535 SECTION 3. (a) Section 1 of this Act takes effect only if
3636 the Act of the 81st Legislature, Regular Session, 2009, relating to
3737 nonsubstantive additions to and corrections in existing codes does
3838 not become law. If the Act of the 81st Legislature, Regular
3939 Session, 2009, relating to nonsubstantive additions to and
4040 corrections in existing codes becomes law, Section 1 of this Act has
4141 no effect.
4242 (b) Section 2 of this Act takes effect only if the Act of the
4343 81st Legislature, Regular Session, 2009, relating to
4444 nonsubstantive additions to and corrections in existing codes
4545 becomes law. If the Act of the 81st Legislature, Regular Session,
4646 2009, relating to nonsubstantive additions to and corrections in
4747 existing codes does not become law, Section 2 of this Act has no
4848 effect.
4949 SECTION 4. This Act takes effect September 1, 2009.
