66 AN ACT
77 relating to the amount and disposition of funds retained by a state
88 agency under the savings incentive program for state agencies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2108.103, Government Code, is amended to
1111 read as follows:
1212 Sec. 2108.103. RETENTION OF FUNDS. (a) The affected
1313 agency retains [one-fourth of] the full amount of savings verified
1414 by the comptroller [, not to exceed one percent of the amount of
1515 undedicated general revenue derived from nonfederal sources
1616 appropriated to the agency for the fiscal year in which the savings
1717 are realized].
1818 (b) Savings retained under this section may only be
1919 appropriated by the legislature to the affected agency.
2020 (c) The administrative head of the agency shall determine
2121 how to spend the savings. The agency may spend the savings only on
2222 an activity or expense that [does not]:
2323 (1) does not create new or expanded services; [or]
2424 (2) does not require ongoing funding at a later date;
2525 and
2626 (3) the administrative head of the agency determines
2727 will enhance the agency's ability to perform the agency's duties.
2828 (d) The agency may spend the savings on one-time merit
2929 payments to employees in accordance with Section 659.255.
3030 SECTION 2. The changes in law made by this Act to Section
3131 2108.103, Government Code, apply beginning with savings made during
3232 the fiscal year ending August 31, 2010.
3333 SECTION 3. This Act takes effect September 1, 2009.
