7 | 7 | | relating to the amount and disposition of funds retained by a state |

8 | 8 | | agency under the savings incentive program for state agencies. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 2108.103, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 2108.103. RETENTION OF FUNDS. (a) The affected |
---|
13 | 13 | | agency retains [one-fourth of] the full amount of savings verified |
---|
14 | 14 | | by the comptroller [, not to exceed one percent of the amount of |
---|
15 | 15 | | undedicated general revenue derived from nonfederal sources |
---|
16 | 16 | | appropriated to the agency for the fiscal year in which the savings |
---|
17 | 17 | | are realized]. |
---|
18 | 18 | | (b) Savings retained under this section may only be |
---|
19 | 19 | | appropriated by the legislature to the affected agency. |
---|
20 | 20 | | (c) The administrative head of the agency shall determine |
---|
21 | 21 | | how to spend the savings. The agency may spend the savings only on |
---|
22 | 22 | | an activity or expense that [does not]: |
---|
23 | 23 | | (1) does not create new or expanded services; [or] |
---|
24 | 24 | | (2) does not require ongoing funding at a later date; |
---|
25 | 25 | | and |
---|
26 | 26 | | (3) the administrative head of the agency determines |
---|
27 | 27 | | will enhance the agency's ability to perform the agency's duties. |
---|
28 | 28 | | (d) The agency may spend the savings on one-time merit |
---|
29 | 29 | | payments to employees in accordance with Section 659.255. |
---|
30 | 30 | | SECTION 2. The changes in law made by this Act to Section |
---|
31 | 31 | | 2108.103, Government Code, apply beginning with savings made during |
---|
32 | 32 | | the fiscal year ending August 31, 2010. |
---|
33 | 33 | | SECTION 3. This Act takes effect September 1, 2009. |
