77 relating to the frequency of water audits by certain retail public
88 utilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 16.0121, Water Code, is amended by
1111 amending Subsections (b), (c), and (f) and adding Subsection (b-1)
1212 to read as follows:
1313 (b) Except as provided by Subsection (b-1) [Every five
1414 years], a retail public utility providing potable water shall
1515 perform and file with the board an annual [a] water audit computing
1616 the utility's [most recent annual] system water loss during the
1717 preceding year.
1818 (b-1) A retail public utility providing potable water that
1919 serves populations of 3,300 or less and that does not receive any
2020 form of financial assistance from the board shall perform and file
2121 with the board every five years a water audit computing the
2222 utility's most recent annual system water loss.
2323 (c) The board shall develop appropriate methodologies and
2424 submission dates for a water audit required under Subsection (b) or
2525 (b-1) for the following categories of retail public utilities:
2626 (1) retail public utilities serving populations of
2727 100,000 or more;
2828 (2) retail public utilities serving populations of
2929 50,000 or more but less than 100,000;
3030 (3) retail public utilities serving populations of
3131 more than 3,300 but less than 50,000; and
3232 (4) retail public utilities serving populations of
3333 3,300 or less.
3434 (f) The board shall compile the information included in the
3535 water audits required by Subsections [Subsection] (b) and (b-1)
3636 according to category of retail public utility and according to
3737 regional water planning area. The regional planning group for a
3838 regional planning area shall use the information to identify
3939 appropriate water management strategies in the development of a
4040 regional water plan under Section 16.053.
4141 SECTION 2. Not later than May 1, 2011, a retail public
4242 utility that receives financial assistance from the Texas Water
4343 Development Board, or a retail public utility that serves a
4444 population of more than 3,300, shall submit the first annual report
4545 required by Section 16.0121, as amended by this Act. The initial
4646 water audit report submitted by a retail public utility under that
4747 section shall compute the utility's most recent annual system water
4848 loss.
4949 SECTION 3. This Act takes effect September 1, 2009.
