7 | 7 | | relating to the composition of the board of trustees of the Teacher |

8 | 8 | | Retirement System of Texas. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 825.001, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 825.001. COMPOSITION OF BOARD OF TRUSTEES. The board |
---|
13 | 13 | | of trustees is composed of 11 [nine] members. |
---|
14 | 14 | | SECTION 2. Sections 825.002(a), (d), and (e), Government |
---|
15 | 15 | | Code, are amended to read as follows: |
---|
16 | 16 | | (a) The governor shall appoint, with the advice and consent |
---|
17 | 17 | | of the senate and as provided by this section, nine [seven] members |
---|
18 | 18 | | of the board of trustees. |
---|
19 | 19 | | (d) The governor shall appoint two members [one member] of |
---|
20 | 20 | | the board from a slate of three former members of the retirement |
---|
21 | 21 | | system who have retired and are receiving benefits from the |
---|
22 | 22 | | retirement system and who have been nominated in accordance with |
---|
23 | 23 | | Subsections (f) and (g) by the persons who have retired and are |
---|
24 | 24 | | receiving benefits from the retirement system. The two members hold |
---|
25 | 25 | | office for staggered terms. |
---|
26 | 26 | | (e) The governor shall appoint two members [one member] from |
---|
27 | 27 | | a slate of three members of the retirement system who are currently |
---|
28 | 28 | | employed by an institution of higher education and who have been |
---|
29 | 29 | | nominated in accordance with Subsection (f) by the members of the |
---|
30 | 30 | | retirement system whose most recent credited service was performed |
---|
31 | 31 | | for an institution of higher education. The two members hold office |
---|
32 | 32 | | for staggered terms. |
---|
33 | 33 | | SECTION 3. (a) Notwithstanding the term of six years |
---|
34 | 34 | | stipulated by Section 825.004(a), Government Code, as soon as |
---|
35 | 35 | | practicable, the retired former members of the Teacher Retirement |
---|
36 | 36 | | System of Texas shall prepare a slate of three nominees and the |
---|
37 | 37 | | governor shall appoint from that slate an additional member to the |
---|
38 | 38 | | board of trustees of the Teacher Retirement System of Texas under |
---|
39 | 39 | | Section 825.002(d), Government Code, as amended by this Act, to |
---|
40 | 40 | | serve a term that expires on a date that preserves the required |
---|
41 | 41 | | staggering of terms. Subsequent board of trustee members appointed |
---|
42 | 42 | | to that position shall serve the six-year term. |
---|
43 | 43 | | (b) Notwithstanding the term of six years stipulated by |
---|
44 | 44 | | Section 825.004(a), Government Code, as soon as practicable, the |
---|
45 | 45 | | members of the Teacher Retirement System of Texas who are currently |
---|
46 | 46 | | employed by an institution of higher education shall prepare a |
---|
47 | 47 | | slate of three nominees and the governor shall appoint from that |
---|
48 | 48 | | slate an additional member to the board of trustees of the Teacher |
---|
49 | 49 | | Retirement System of Texas under Section 825.002(e), Government |
---|
50 | 50 | | Code, as amended by this Act, to serve a term that expires on a date |
---|
51 | 51 | | that preserves the required staggering of terms. Subsequent board |
---|
52 | 52 | | of trustee members appointed to that position shall serve the |
---|
53 | 53 | | six-year term. |
---|
54 | 54 | | SECTION 4. This Act takes effect immediately if it receives |
---|
55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 58 | | Act takes effect September 1, 2009. |
