55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to compliance by a school district with requirements for a
88 disciplinary alternative education program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.008, Education Code, is amended by
1111 adding Subsections (o) and (o-1) to read as follows:
1212 (o) This subsection applies to a school district's
1313 disciplinary alternative education program regardless of whether
1414 the program is operated by the district, by an entity under contract
1515 with the district, or, if the district is primarily responsible for
1616 daily operations of the program, by a shared services arrangement.
1717 The superintendent of a district annually shall provide to the
1818 commissioner, in the time and manner established by commissioner
1919 rule, written notice of, as applicable:
2020 (1) the compliance by each district disciplinary
2121 alternative education program with this section and with each rule
2222 adopted under Subsection (a-1) or another provision of this
2323 section; or
2424 (2) any failure of a district disciplinary alternative
2525 education program to comply with this section or a rule adopted
2626 under this section.
2727 (o-1) The written notice under Subsection (o)(2) must
2828 specifically explain any failure of a district disciplinary
2929 alternative education program to comply with this section or a rule
3030 adopted under this section.
3131 SECTION 2. This Act applies beginning with the 2009-2010
3232 school year.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2009.
