55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study regarding the health and safety issues posed by
88 uncovered ditches that abut surface streets.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In this section, "department" means the
1111 Department of State Health Services.
1212 (b) The department shall conduct a study regarding the
1313 health and safety issues that may arise from the presence of
1414 uncovered ditches that abut surface streets.
1515 (c) The study must:
1616 (1) identify any health and safety concerns posed by
1717 uncovered ditches that abut surface streets, including:
1818 (A) the public health issues that may arise from
1919 standing water accumulating in ditches; and
2020 (B) traffic hazards that may be caused by the
2121 ditches; and
2222 (2) propose solutions to address any problems
2323 identified.
2424 (d) Not later than September 1, 2010, the department shall
2525 submit to the governor, lieutenant governor, speaker of the house
2626 of representatives, and presiding officers of the relevant standing
2727 committees of the legislature with jurisdiction over the department
2828 a written report containing the findings of the study and the
2929 department's recommendations.
3030 (e) This Act expires September 1, 2011.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2009.
