| 7 | 7 | | relating to a study regarding the health and safety issues posed by |
|---|
| 8 | 8 | | uncovered ditches that abut surface streets. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. (a) In this section, "department" means the |
|---|
| 11 | 11 | | Department of State Health Services. |
|---|
| 12 | 12 | | (b) The department shall conduct a study regarding the |
|---|
| 13 | 13 | | health and safety issues that may arise from the presence of |
|---|
| 14 | 14 | | uncovered ditches that abut surface streets. |
|---|
| 15 | 15 | | (c) The study must: |
|---|
| 16 | 16 | | (1) identify any health and safety concerns posed by |
|---|
| 17 | 17 | | uncovered ditches that abut surface streets, including: |
|---|
| 18 | 18 | | (A) the public health issues that may arise from |
|---|
| 19 | 19 | | standing water accumulating in ditches; and |
|---|
| 20 | 20 | | (B) traffic hazards that may be caused by the |
|---|
| 21 | 21 | | ditches; and |
|---|
| 22 | 22 | | (2) propose solutions to address any problems |
|---|
| 23 | 23 | | identified. |
|---|
| 24 | 24 | | (d) Not later than September 1, 2010, the department shall |
|---|
| 25 | 25 | | submit to the governor, lieutenant governor, speaker of the house |
|---|
| 26 | 26 | | of representatives, and presiding officers of the relevant standing |
|---|
| 27 | 27 | | committees of the legislature with jurisdiction over the department |
|---|
| 28 | 28 | | a written report containing the findings of the study and the |
|---|
| 29 | 29 | | department's recommendations. |
|---|
| 30 | 30 | | (e) This Act expires September 1, 2011. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
