5	5	relating to the powers of a sheriff's department civil service
6	6	commission in certain counties regarding an appeal of a
7	7	disciplinary action.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 158.035, Local Government Code, is
10	10	amended by adding Subsection (d) to read as follows:
11	11	(d) In rendering a final decision regarding a disciplinary
12	12	action by the department, the commission may only sustain,
13	13	overturn, or reduce the disciplinary action. The commission may
14	14	not enhance a disciplinary action by the department.
15	15	SECTION 2. The change in law made by this Act applies only
16	16	to a decision made by a sheriff's department civil service
17	17	commission on or after the effective date of this Act. A decision
18	18	made by a sheriff's department civil service commission before the
19	19	effective date of this Act is governed by the law in effect when the
20	20	decision was made, and the former law is continued in effect for
21	21	that purpose.
22	22	SECTION 3. This Act takes effect September 1, 2009.
