55 relating to the powers of a sheriff's department civil service

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 158.035, Local Government Code, is
1010 amended by adding Subsection (d) to read as follows:
1111 (d) In rendering a final decision regarding a disciplinary
1212 action by the department, the commission may only sustain,
1313 overturn, or reduce the disciplinary action. The commission may
1414 not enhance a disciplinary action by the department.
1515 SECTION 2. The change in law made by this Act applies only
1616 to a decision made by a sheriff's department civil service
1717 commission on or after the effective date of this Act. A decision
1818 made by a sheriff's department civil service commission before the
1919 effective date of this Act is governed by the law in effect when the
2020 decision was made, and the former law is continued in effect for
2121 that purpose.
2222 SECTION 3. This Act takes effect September 1, 2009.
