66 AN ACT
77 relating to the minimum number of county jailers necessary to staff
88 a county jail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 351, Local Government
1111 Code, is amended by adding Section 351.045 to read as follows:
1212 Sec. 351.045. MINIMUM STAFF. (a) The sheriff or the
1313 administrator of a county jail, as applicable, shall employ at
1414 least one county jailer for every 48 inmates housed in the county
1515 jail.
1616 (b) The commissioners court of a county shall provide
1717 sufficient funding for the employment of county jailers in the
1818 number required by this section.
1919 SECTION 2. Section 351.045, Local Government Code, as added
2020 by this Act, applies to the commissioners court of a county and to
2121 the sheriff or jail administrator of a county beginning on the first
2222 day of the first county fiscal year that begins after the effective
2323 date of this Act.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2009.
