| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 580, Local Government Code, as effective |
|---|
| 11 | 11 | | April 1, 2009, is amended by adding Section 580.004 to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | Sec. 580.004. EXEMPTIONS FROM STORM WATER UTILITY FEES IN |
|---|
| 14 | 14 | | CERTAIN COUNTIES. (a) In this section, "storm water utility" means |
|---|
| 15 | 15 | | a legal entity that provides the service of managing, maintaining, |
|---|
| 16 | 16 | | and improving a storm water system. |
|---|
| 17 | 17 | | (b) This section applies only to a storm water utility |
|---|
| 18 | 18 | | located in a county with a population of at least 600,000 and |
|---|
| 19 | 19 | | located on the international border. |
|---|
| 20 | 20 | | (c) A storm water utility established by a municipality may |
|---|
| 21 | 21 | | not impose a storm water fee on property owned by: |
|---|
| 22 | 22 | | (1) a school district located in the municipality; or |
|---|
| 23 | 23 | | (2) the county in which the municipality is located. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by Section 580.004, Local |
|---|
| 25 | 25 | | Government Code, as added by this Act, does not apply to a storm |
|---|
| 26 | 26 | | water fee imposed under a contract entered into or renewed before |
|---|
| 27 | 27 | | the effective date of this Act. A contract with a storm water |
|---|
| 28 | 28 | | utility entered into or renewed before the effective date of this |
|---|
| 29 | 29 | | Act is governed by the law in effect on the date the contract was |
|---|
| 30 | 30 | | entered into or renewed, and the former law is continued in effect |
|---|
| 31 | 31 | | for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2009. |
