| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 552.053, Local Government Code, as |
|---|
| 13 | 13 | | effective April 1, 2009, is amended by adding Subsection (e) to read |
|---|
| 14 | 14 | | as follows: |
|---|
| 15 | 15 | | (e) A municipality described by Section 552.044(8)(A) shall |
|---|
| 16 | 16 | | exempt property owned by a county or school district from drainage |
|---|
| 17 | 17 | | charges under Section 552.047 and all ordinances, resolutions, and |
|---|
| 18 | 18 | | rules adopted under this subchapter. |
|---|
| 19 | 19 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 20 | 20 | | a fee assessed by a municipality on or after the effective date of |
|---|
| 21 | 21 | | this Act. A fee assessed by a municipality before the effective date |
|---|
| 22 | 22 | | of this Act is governed by the law in effect on the date the fee was |
|---|
| 23 | 23 | | assessed, and the former law is continued in effect for that |
|---|
| 24 | 24 | | purpose. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
