7 | 7 | relating to governmental agency contracts that involve the | |
8 | 8 | production of cement. | |
9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 271.907, Local Government Code, is | |
11 | 11 | amended by amending Subsection (d) and adding Subsection (e) to | |
12 | 12 | read as follows: | |
13 | 13 | (d) A preference provided by Subsection (c) or (e) [The | |
14 | 14 | preference] may be given only if the cost to the governmental agency | |
15 | 15 | for the goods or services would not exceed 105 percent of the cost | |
16 | 16 | of the goods or services provided by a vendor who does not meet the | |
17 | 17 | standards. | |
18 | 18 | (e) A governmental agency procuring goods or services that | |
19 | 19 | involve the production of cement may give preference to goods or | |
20 | 20 | services of a vendor that demonstrates that the cement was produced | |
21 | 21 | from a portland cement kiln that: | |
22 | 22 | (1) utilizes a dry raw material feed precalciner | |
23 | 23 | pyroprocessing technology; and | |
24 | 24 | (2) meets or exceeds regulatory requirements for | |
25 | 25 | emissions of nitrogen oxide. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2009. |
