88 Municipal Utility District No. 7; providing authority to impose a

1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 8323 to read as follows:
1313 CHAPTER 8323. SIENNA PLANTATION MUNICIPAL UTILITY DISTRICT NO. 7
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8323.001. DEFINITION. In this chapter, "district"
1616 means the Sienna Plantation Municipal Utility District No. 7.
1717 Sec. 8323.002. NATURE AND PURPOSES OF DISTRICT. (a) The
1818 district is a municipal utility district created under and
1919 essential to accomplish the purposes of Section 59, Article XVI,
2020 Texas Constitution.
2121 (b) The district is essential to accomplish the purposes of
2222 Section 52, Article III, Texas Constitution, that relate to the
2323 construction, acquisition, improvement, operation, or maintenance
2424 of macadamized, graveled, or paved roads, or improvements,
2525 including storm drainage, in aid of those roads.

2727 SUBCHAPTER B. POWERS AND DUTIES
2828 Sec. 8323.051. GENERAL POWERS AND DUTIES. The district has
2929 the powers and duties necessary to accomplish the purposes
3030 described by Section 8323.002.
3131 Sec. 8323.052. MUNICIPAL UTILITY DISTRICT POWERS AND
3232 DUTIES. The district has the powers and duties provided by the
3333 general law of this state, including Chapters 49 and 54, Water Code,
3434 applicable to municipal utility districts created under Section 59,
3535 Article XVI, Texas Constitution.
3636 Sec. 8323.053. AUTHORITY FOR ROAD PROJECTS. Under Section
3737 52, Article III, Texas Constitution, the district may design,
3838 acquire, construct, finance, issue bonds for, improve, operate,
3939 maintain, and convey to this state, a county, or a municipality for
4040 operation and maintenance macadamized, graveled, or paved roads, or
4141 improvements, including storm drainage, in aid of those roads.
4242 Sec. 8323.054. ROAD STANDARDS AND REQUIREMENTS. (a) A
4343 road project must meet all applicable construction standards,
4444 zoning and subdivision requirements, and regulations of each
4545 municipality in whose corporate limits or extraterritorial
4646 jurisdiction the road project is located.
4747 (b) If a road project is not located in the corporate limits
4848 or extraterritorial jurisdiction of a municipality, the road
4949 project must meet all applicable construction standards,
5050 subdivision requirements, and regulations of each county in which
5151 the road project is located.
5252 (c) If the state will maintain and operate the road, the
5353 Texas Transportation Commission must approve the plans and
5454 specifications of the road project.
5555 (d) Except as provided by Subsection (c), the district is
5656 not required to obtain approval from the Texas Transportation
5757 Commission to design, acquire, construct, finance, issue bonds for,
5858 improve, operate, maintain, or convey a road project.

6060 SUBCHAPTER C. BONDS AND OTHER OBLIGATIONS
6161 Sec. 8323.101. AUTHORITY TO ISSUE BONDS AND OTHER
6262 OBLIGATIONS FOR ROAD PROJECTS. (a) The district may issue bonds or
6363 other obligations payable wholly or partly from ad valorem taxes,
6464 impact fees, revenue, contract payments, grants, or other district
6565 money, or any combination of those sources, to pay for a road
6666 project authorized by Section 8323.053.
6767 (b) The district may not issue bonds payable from ad valorem
6868 taxes to finance a road project unless the issuance is approved by a
6969 vote of a two-thirds majority of the district voters voting at an
7070 election held for that purpose.
7171 (c) At the time of issuance, the total principal amount of
7272 bonds or other obligations issued or incurred to finance road
7373 projects and payable from ad valorem taxes may not exceed
7474 one-fourth of the assessed value of the real property in the
7575 district.
7676 Sec. 8323.102. TAXES FOR BONDS. At the time the district
7777 issues bonds payable wholly or partly from ad valorem taxes, the
7878 district shall provide for the annual imposition of a continuing
7979 direct ad valorem tax, without limit as to rate or amount, while all
8080 or part of the bonds are outstanding as required and in the manner
8181 provided by Sections 54.601 and 54.602, Water Code.
8282 SECTION 2. The Sienna Plantation Municipal Utility District
8383 No. 7 retains all the rights, powers, privileges, authority,
8484 duties, and functions that it had before the effective date of this
8585 Act.
8686 SECTION 3. (a) The legal notice of the intention to
8787 introduce this Act, setting forth the general substance of this
8888 Act, has been published as provided by law, and the notice and a
8989 copy of this Act have been furnished to all persons, agencies,
9090 officials, or entities to which they are required to be furnished
9191 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
9292 Government Code.
9393 (b) The governor, one of the required recipients, has
9494 submitted the notice and Act to the Texas Commission on
9595 Environmental Quality.
9696 (c) The Texas Commission on Environmental Quality has filed
9797 its recommendations relating to this Act with the governor, the
9898 lieutenant governor, and the speaker of the house of
9999 representatives within the required time.
100100 (d) All requirements of the constitution and laws of this
101101 state and the rules and procedures of the legislature with respect
102102 to the notice, introduction, and passage of this Act are fulfilled
103103 and accomplished.
104104 SECTION 4. This Act takes effect immediately if it receives
105105 a vote of two-thirds of all the members elected to each house, as
106106 provided by Section 39, Article III, Texas Constitution. If this
107107 Act does not receive the vote necessary for immediate effect, this
108108 Act takes effect September 1, 2009.
