| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2305.038, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (c) to read as follows: |
|---|
| 12 | 12 | | (c) The comptroller, with the cooperation of the Texas |
|---|
| 13 | 13 | | Education Agency, shall develop information designed to promote |
|---|
| 14 | 14 | | awareness of the resources available under this section. The |
|---|
| 15 | 15 | | comptroller and the agency shall distribute the information |
|---|
| 16 | 16 | | annually to school district superintendents and energy management |
|---|
| 17 | 17 | | staff through: |
|---|
| 18 | 18 | | (1) e-mail notifications; |
|---|
| 19 | 19 | | (2) printed materials; and |
|---|
| 20 | 20 | | (3) information posted on the Internet websites |
|---|
| 21 | 21 | | maintained by the comptroller and the agency. |
|---|
| 22 | 22 | | SECTION 2. Subchapter F, Chapter 271, Local Government |
|---|
| 23 | 23 | | Code, is amended by adding Section 271.1021 to read as follows: |
|---|
| 24 | 24 | | Sec. 271.1021. COOPERATIVE PURCHASING PROGRAM DATABASE. |
|---|
| 25 | 25 | | (a) The comptroller shall establish and post on the comptroller's |
|---|
| 26 | 26 | | Internet website a database of cooperative purchasing programs |
|---|
| 27 | 27 | | available to a school district. The database must include: |
|---|
| 28 | 28 | | (1) the membership requirements and membership fees of |
|---|
| 29 | 29 | | each program; |
|---|
| 30 | 30 | | (2) a description of the broad commodity and service |
|---|
| 31 | 31 | | categories offered by each program; and |
|---|
| 32 | 32 | | (3) a link to each program's Internet website. |
|---|
| 33 | 33 | | (b) The comptroller shall consult with each local |
|---|
| 34 | 34 | | government participating in a cooperative purchasing program |
|---|
| 35 | 35 | | before including the program's information on the database |
|---|
| 36 | 36 | | established under Subsection (a). |
|---|
| 37 | 37 | | (c) The comptroller and the Texas Education Agency shall, |
|---|
| 38 | 38 | | through e-mail, annually notify school district superintendents |
|---|
| 39 | 39 | | and purchasing staff of the database established under Subsection |
|---|
| 40 | 40 | | (a). |
|---|
| 41 | 41 | | SECTION 3. Not later than January 1, 2010, the comptroller |
|---|
| 42 | 42 | | of public accounts shall establish the database required by Section |
|---|
| 43 | 43 | | 271.1021, Local Government Code, as added by this Act. |
|---|
| 44 | 44 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 46 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 47 | 47 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 48 | 48 | | Act takes effect September 1, 2009. |
