| 5 | 5 | | relating to the payment of a vehicle registration fee by a check |

| 6 | 6 | | drawn against insufficient funds. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 502.181(a), Transportation Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (a) A county assessor-collector who receives from any |
|---|
| 11 | 11 | | person a check or draft drawn on a bank or trust company in payment |
|---|
| 12 | 12 | | of a registration fee for a registration year that has not ended on |
|---|
| 13 | 13 | | a motor vehicle, trailer, or motorcycle sidecar that is returned |
|---|
| 14 | 14 | | unpaid because of insufficient funds or no funds in the bank or |
|---|
| 15 | 15 | | trust company to the credit of the drawer of the check or draft |
|---|
| 16 | 16 | | shall [immediately] certify the fact to the sheriff or a constable |
|---|
| 17 | 17 | | or highway patrol officer in the county after attempts to contact |
|---|
| 18 | 18 | | the person fail to result in the collection of payment. The |
|---|
| 19 | 19 | | certification must be made before the 30th day after the date the |
|---|
| 20 | 20 | | check or draft is returned unpaid and: |
|---|
| 21 | 21 | | (1) be under the assessor-collector's official seal; |
|---|
| 22 | 22 | | (2) include the name and address of the person who gave |
|---|
| 23 | 23 | | the assessor-collector the check or draft; |
|---|
| 24 | 24 | | (3) include the license plate number and make of the |
|---|
| 25 | 25 | | vehicle; [and] |
|---|
| 26 | 26 | | (4) be accompanied by the check or draft; and |
|---|
| 27 | 27 | | (5) be accompanied by documentation of any attempt to |
|---|
| 28 | 28 | | contact the person and collect payment. |
|---|
| 29 | 29 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 30 | 30 | | to a payment of a registration fee submitted to a county |
|---|
| 31 | 31 | | assessor-collector on or after the effective date of this Act. A |
|---|
| 32 | 32 | | payment submitted before the effective date of this Act is governed |
|---|
| 33 | 33 | | by the law in effect on the date the payment was submitted, and the |
|---|
| 34 | 34 | | former law is continued in effect for that purpose. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2009. |
