| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 12, Property Code, is amended by adding | |
| 11 | 11 | Section 12.0012 to read as follows: | |
| 12 | 12 | Sec. 12.0012. FILING OF CERTAIN AFFIDAVITS WITHOUT | |
| 13 | 13 | ACCOMPANYING INSTRUMENT. An affidavit purporting to relate to a | |
| 14 | 14 | paper document concerning real or personal property, as required by | |
| 15 | 15 | Section 12.0011, that is not attached to a paper document | |
| 16 | 16 | concerning real or personal property may not be recorded or serve as | |
| 17 | 17 | notice of the paper document. A county clerk is not required to | |
| 18 | 18 | accept an affidavit described by this section. | |
| 19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2009. |
