9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter B, Chapter 22, Government Code, is | |
11 | 11 | amended by adding Section 22.113 to read as follows: | |
12 | 12 | Sec. 22.113. COURT HOURS ON DAY OF EXECUTION. On a day a | |
13 | 13 | convict is scheduled to be executed, the court of criminal appeals | |
14 | 14 | and clerk's office for the court shall remain open until the | |
15 | 15 | execution has occurred if the court has been notified by the | |
16 | 16 | attorney of record for the convict that the attorney will file | |
17 | 17 | documents with the court requesting a stay of execution. | |
18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
22 | 22 | Act takes effect September 1, 2009. |
