66 AN ACT
77 relating to suspension or cancellation of certain alcoholic
88 beverage permits for nonpayment of accounts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 11, Alcoholic Beverage
1111 Code, is amended by adding Section 11.614 to read as follows:
1212 Sec. 11.614. SUSPENSION OR CANCELLATION FOR NONPAYMENT OF
1313 ACCOUNT. (a) Subject to Subsection (b), the commission may, after
1414 notice and hearing, cancel or suspend a wholesaler's, general class
1515 B wholesaler's, or local class B wholesaler's permit on proof that
1616 the permit holder, after reasonable opportunity to do so, failed to
1717 make a timely and sufficient payment for a product purchased from
1818 the holder of a nonresident seller's, nonresident brewer's,
1919 brewer's, or distiller's and rectifier's permit.
2020 (b) The commission may cancel or suspend a permit under this
2121 section only after receipt of a complaint by the permit holder to
2222 whom payment is owed.
2323 SECTION 2. The change in law made by this Act applies only
2424 to payment for a product purchased on or after the effective date of
2525 this Act. Payment for a product purchased before the effective date
2626 of this Act is governed by the law in effect immediately before that
2727 date, and that law is continued in effect for that purpose.
2828 SECTION 3. This Act takes effect September 1, 2009.
