| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 11, Alcoholic Beverage |
|---|
| 11 | 11 | | Code, is amended by adding Section 11.614 to read as follows: |

| 12 | 12 | | Sec. 11.614. SUSPENSION OR CANCELLATION FOR NONPAYMENT OF |
|---|
| 13 | 13 | | ACCOUNT. (a) Subject to Subsection (b), the commission may, after |
|---|
| 14 | 14 | | notice and hearing, cancel or suspend a wholesaler's, general class |
|---|
| 15 | 15 | | B wholesaler's, or local class B wholesaler's permit on proof that |
|---|
| 16 | 16 | | the permit holder, after reasonable opportunity to do so, failed to |
|---|
| 17 | 17 | | make a timely and sufficient payment for a product purchased from |
|---|
| 18 | 18 | | the holder of a nonresident seller's, nonresident brewer's, |
|---|
| 19 | 19 | | brewer's, or distiller's and rectifier's permit. |
|---|
| 20 | 20 | | (b) The commission may cancel or suspend a permit under this |
|---|
| 21 | 21 | | section only after receipt of a complaint by the permit holder to |
|---|
| 22 | 22 | | whom payment is owed. |
|---|
| 23 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 24 | 24 | | to payment for a product purchased on or after the effective date of |
|---|
| 25 | 25 | | this Act. Payment for a product purchased before the effective date |
|---|
| 26 | 26 | | of this Act is governed by the law in effect immediately before that |
|---|
| 27 | 27 | | date, and that law is continued in effect for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2009. |
