66 AN ACT
77 relating to prohibitions on the use of a wireless communication
88 device while operating a motor vehicle.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 545.425, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 545.425. USE OF WIRELESS COMMUNICATION DEVICE [BY
1313 CERTAIN MOTORISTS]. (a) In this section, "hands-free device"
1414 means speakerphone capability or a telephone attachment or other
1515 piece of equipment, regardless of whether permanently installed in
1616 the motor vehicle, that allows use of the wireless communication
1717 device without use of either of the operator's hands.
1818 (b) Except as provided by Subsection (c), an operator may
1919 not use a wireless communication device while operating a motor
2020 vehicle unless:
2121 (1) the vehicle is stopped; or
2222 (2) the wireless communication device is used with a
2323 hands-free device.
2424 (c) An operator [A person] may not use a wireless
2525 communication device while operating a passenger bus with a minor
2626 passenger on the bus unless [except in case of emergency or if] the
2727 passenger bus is stopped [not in motion].
2828 (d) It is an affirmative defense to prosecution under this
2929 section that the wireless communication device was used to make an
3030 emergency call to:
3131 (1) an emergency response service, including a rescue,
3232 emergency medical, or hazardous material response service;
3333 (2) a hospital;
3434 (3) a fire department;
3535 (4) a health clinic;
3636 (5) a medical doctor's office;
3737 (6) an individual to administer first aid treatment;
3838 or
3939 (7) a law enforcement agency.
4040 (e) This section does not apply if:
4141 (1) the operator is a peace officer or an emergency
4242 response provider; and
4343 (2) the use of the wireless communication device is in
4444 connection with official duties.
4545 (f) An offense under this section is a misdemeanor
4646 punishable by a fine of:
4747 (1) not less than $25 or more than $100 if the offense
4848 occurs outside a school crossing zone; or
4949 (2) not less than $125 or more than $200 if the offense
5050 occurs within a school crossing zone.
5151 SECTION 2. The change in law made by this Act applies only
5252 to an offense committed on or after the effective date of this Act.
5353 An offense committed before the effective date of this Act is
5454 governed by the law in effect when the offense was committed, and
5555 the former law is continued in effect for that purpose. For
5656 purposes of this section, an offense was committed before the
5757 effective date of this Act if any element of the offense was
5858 committed before that date.
5959 SECTION 3. This Act takes effect September 1, 2009.
