| 10 | 10 | SECTION 1. Subchapter A, Chapter 17, Utilities Code, is | |
| 11 | 11 | amended by adding Section 17.010 to read as follows: | |
| 12 | 12 | Sec. 17.010. MAINTENANCE OF UTILITY POLES. (a) The | |
| 13 | 13 | commission by rule shall ensure that electric and | |
| 14 | 14 | telecommunications utilities maintain telephone and electric | |
| 15 | 15 | utility poles so that they stand at an angle that varies no more | |
| 16 | 16 | than 30 percent from a line that is perpendicular to the ground. | |
| 17 | 17 | (b) A municipality or county by ordinance or order may | |
| 18 | 18 | ensure that electric and telecommunications utilities maintain | |
| 19 | 19 | telephone and electric utility poles so that they stand at an angle | |
| 20 | 20 | that varies no more than 30 percent from a line that is | |
| 21 | 21 | perpendicular to the ground. | |
| 22 | 22 | SECTION 2. This Act takes effect September 1, 2009. |
