55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of the executive commissioner of the
88 Health and Human Services Commission to require immunization
99 against human papillomavirus for a person's admission to elementary
1010 or secondary school.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 38.001(b), Education Code, as amended by
1313 Chapters 43 (H.B. 1098) and 94 (H.B. 1059), Acts of the 80th
1414 Legislature, Regular Session, 2007, is reenacted and amended to
1515 read as follows:
1616 (b) Subject to Subsection [Subsections (b-1) and] (c), the
1717 executive commissioner of the Health and Human Services Commission
1818 by rule adopted for the Department of State Health Services may
1919 modify or delete any of the immunizations in Subsection (a) or may
2020 require immunizations against additional diseases as a requirement
2121 for admission to any elementary or secondary school.
2222 SECTION 2. Section 38.001(b-1), Education Code, as added by
2323 Chapter 43 (H.B. 1098), Acts of the 80th Legislature, Regular
2424 Session, 2007, is repealed.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2009.
