| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 38.001(b), Education Code, as amended by |
|---|
| 13 | 13 | | Chapters 43 (H.B. 1098) and 94 (H.B. 1059), Acts of the 80th |
|---|
| 14 | 14 | | Legislature, Regular Session, 2007, is reenacted and amended to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | (b) Subject to Subsection [Subsections (b-1) and] (c), the |
|---|
| 17 | 17 | | executive commissioner of the Health and Human Services Commission |
|---|
| 18 | 18 | | by rule adopted for the Department of State Health Services may |
|---|
| 19 | 19 | | modify or delete any of the immunizations in Subsection (a) or may |
|---|
| 20 | 20 | | require immunizations against additional diseases as a requirement |
|---|
| 21 | 21 | | for admission to any elementary or secondary school. |
|---|
| 22 | 22 | | SECTION 2. Section 38.001(b-1), Education Code, as added by |
|---|
| 23 | 23 | | Chapter 43 (H.B. 1098), Acts of the 80th Legislature, Regular |
|---|
| 24 | 24 | | Session, 2007, is repealed. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
|---|
