1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the minimum standards for licensed child-care
1313 facilities and registered family homes.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. This Act shall be known as Paisley's Law.
1616 SECTION 2. Section 42.042(e), Human Resources Code, is
1717 amended to read as follows:
1818 (e) The department shall promulgate minimum standards that
1919 apply to licensed child-care facilities and to registered family
2020 homes covered by this chapter and that will:
2121 (1) promote the health, safety, and welfare of
2222 children attending a facility or registered family home;
2323 (2) promote safe, comfortable, and healthy physical
2424 facilities and registered family homes for children;
2525 (3) ensure adequate supervision of children by
2626 capable, qualified, and healthy personnel;
2727 (4) ensure adequate and healthy food service where
2828 food service is offered;
2929 (5) prohibit racial discrimination by child-care
3030 facilities and registered family homes;
3131 (6) require procedures for parental and guardian
3232 consultation in the formulation of children's educational and
3333 therapeutic programs; [and]
3434 (7) prevent the breakdown of foster care and adoptive
3535 placement; and
3636 (8) ensure that a child-care facility or registered
3737 family home follows the written directives from a child's physician
3838 or other health care professional licensed under the Occupations
3939 Code when providing specialized medical assistance required by the
4040 child.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2009.
