12 | 12 | | relating to the minimum standards for licensed child-care |
---|
13 | 13 | | facilities and registered family homes. |

14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
15 | 15 | | SECTION 1. This Act shall be known as Paisley's Law. |
---|
16 | 16 | | SECTION 2. Section 42.042(e), Human Resources Code, is |
---|
17 | 17 | | amended to read as follows: |
---|
18 | 18 | | (e) The department shall promulgate minimum standards that |
---|
19 | 19 | | apply to licensed child-care facilities and to registered family |
---|
20 | 20 | | homes covered by this chapter and that will: |
---|
21 | 21 | | (1) promote the health, safety, and welfare of |
---|
22 | 22 | | children attending a facility or registered family home; |
---|
23 | 23 | | (2) promote safe, comfortable, and healthy physical |
---|
24 | 24 | | facilities and registered family homes for children; |
---|
25 | 25 | | (3) ensure adequate supervision of children by |
---|
26 | 26 | | capable, qualified, and healthy personnel; |
---|
27 | 27 | | (4) ensure adequate and healthy food service where |
---|
28 | 28 | | food service is offered; |
---|
29 | 29 | | (5) prohibit racial discrimination by child-care |
---|
30 | 30 | | facilities and registered family homes; |
---|
31 | 31 | | (6) require procedures for parental and guardian |
---|
32 | 32 | | consultation in the formulation of children's educational and |
---|
33 | 33 | | therapeutic programs; [and] |
---|
34 | 34 | | (7) prevent the breakdown of foster care and adoptive |
---|
35 | 35 | | placement; and |
---|
36 | 36 | | (8) ensure that a child-care facility or registered |
---|
37 | 37 | | family home follows the written directives from a child's physician |
---|
38 | 38 | | or other health care professional licensed under the Occupations |
---|
39 | 39 | | Code when providing specialized medical assistance required by the |
---|
40 | 40 | | child. |
---|
41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
---|
42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
---|
43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
---|
45 | 45 | | Act takes effect September 1, 2009. |
