5	5	relating to the timing of a referendum election to continue a fire
6	6	control, prevention, and emergency medical services district.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 344.251(d), Local Government Code, is
9	9	amended to read as follows:
10	10	(d) The board may not hold a referendum election under this
11	11	subchapter before the fourth [fifth] anniversary of the date the
12	12	district was created or before the third anniversary of the date of
13	13	the last continuation or dissolution referendum election.
14	14	SECTION 2. This Act takes effect immediately if it receives
15	15	a vote of two-thirds of all the members elected to each house, as
16	16	provided by Section 39, Article III, Texas Constitution. If this
17	17	Act does not receive the vote necessary for immediate effect, this
18	18	Act takes effect September 1, 2009.
