55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to transferring the Office of Rural Community Affairs to
88 the Department of Agriculture and abolishing the board of the
99 office.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 487.001, Government Code, is amended to
1212 read as follows:
1313 Sec. 487.001. DEFINITIONS. In this chapter:
1414 (1) "Board" means the Department of Agriculture [board
1515 of the Office of Rural Community Affairs].
1616 (2) "Commissioner" means the commissioner of
1717 agriculture.
1818 (3) "Department" means the Department of Agriculture.
1919 (4) "Office" means the Office of Rural Community
2020 Affairs within the department.
2121 SECTION 2. Subchapter A, Chapter 487, Government Code, is
2222 amended by adding Sections 487.003 and 487.004 to read as follows:
2323 Sec. 487.003. OFFICE OF RURAL COMMUNITY AFFAIRS. The
2424 Office of Rural Community Affairs is established within the
2525 department.
2626 Sec. 487.004. REFERENCE IN LAW. A reference in this chapter
2727 or other law to the board of the Office of Rural Community Affairs
2828 means the commissioner.
2929 SECTION 3. The following laws are repealed:
3030 (1) Sections 487.002, 487.021, 487.022, 487.023,
3131 487.024, 487.025, 487.029, 487.058, and 487.352, Government Code;
3232 and
3333 (2) Section 487.051(b), Government Code, as added by
3434 Chapter 1241 (H.B. 2542), Acts of the 80th Legislature, Regular
3535 Session, 2007.
3636 SECTION 4. (a) The Office of Rural Community Affairs is
3737 abolished as an independent agency and created as a program in the
3838 Department of Agriculture. The board of the Office of Rural
3939 Community Affairs is abolished.
4040 (b) The validity of an action taken by the Office of Rural
4141 Community Affairs or its board before either is abolished under
4242 Subsection (a) of this section is not affected by the abolishment.
4343 SECTION 5. On September 1, 2009:
4444 (1) the executive director of the Office of Rural
4545 Community Affairs becomes the executive director of the Office of
4646 Rural Community Affairs in the Department of Agriculture;
4747 (2) an employee of the Office of Rural Community
4848 Affairs becomes an employee of the Office of Rural Community
4949 Affairs in the Department of Agriculture;
5050 (3) a reference in law to the Office of Rural Community
5151 Affairs means the Office of Rural Community Affairs in the
5252 Department of Agriculture;
5353 (4) all money, contracts, leases, rights, and
5454 obligations of the Office of Rural Community Affairs are
5555 transferred to the Office of Rural Community Affairs in the
5656 Department of Agriculture;
5757 (5) all property, including records, in the custody of
5858 the Office of Rural Community Affairs becomes the property of the
5959 Office of Rural Community Affairs in the Department of Agriculture;
6060 and
6161 (6) all funds appropriated by the legislature to the
6262 Office of Rural Community Affairs are transferred to the Office of
6363 Rural Community Affairs in the Department of Agriculture.
6464 SECTION 6. A function or activity performed by the Office of
6565 Rural Community Affairs is transferred to the Office of Rural
6666 Community Affairs in the Department of Agriculture as provided by
6767 this Act.
6868 SECTION 7. The Office of Rural Community Affairs and the
6969 Department of Agriculture shall establish a transition plan for the
7070 transfer described in Section 5 of this Act.
7171 SECTION 8. This Act takes effect September 1, 2009.
