6	6	AN ACT
7	7	relating to transferring the Office of Rural Community Affairs to
8	8	the Department of Agriculture and abolishing the board of the
9	9	office.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 487.001, Government Code, is amended to
12	12	read as follows:
13	13	Sec. 487.001. DEFINITIONS. In this chapter:
14	14	(1) "Board" means the Department of Agriculture [board
15	15	of the Office of Rural Community Affairs].
16	16	(2) "Commissioner" means the commissioner of
17	17	agriculture.
18	18	(3) "Department" means the Department of Agriculture.
19	19	(4) "Office" means the Office of Rural Community
20	20	Affairs within the department.
21	21	SECTION 2. Subchapter A, Chapter 487, Government Code, is
22	22	amended by adding Sections 487.003 and 487.004 to read as follows:
23	23	Sec. 487.003. OFFICE OF RURAL COMMUNITY AFFAIRS. The
24	24	Office of Rural Community Affairs is established within the
25	25	department.
26	26	Sec. 487.004. REFERENCE IN LAW. A reference in this chapter
27	27	or other law to the board of the Office of Rural Community Affairs
28	28	means the commissioner.
29	29	SECTION 3. The following laws are repealed:
30	30	(1) Sections 487.002, 487.021, 487.022, 487.023,
31	31	487.024, 487.025, 487.029, 487.058, and 487.352, Government Code;
32	32	and
33	33	(2) Section 487.051(b), Government Code, as added by
34	34	Chapter 1241 (H.B. 2542), Acts of the 80th Legislature, Regular
35	35	Session, 2007.
36	36	SECTION 4. (a) The Office of Rural Community Affairs is
37	37	abolished as an independent agency and created as a program in the
38	38	Department of Agriculture. The board of the Office of Rural
39	39	Community Affairs is abolished.
40	40	(b) The validity of an action taken by the Office of Rural
41	41	Community Affairs or its board before either is abolished under
42	42	Subsection (a) of this section is not affected by the abolishment.
43	43	SECTION 5. On September 1, 2009:
44	44	(1) the executive director of the Office of Rural
45	45	Community Affairs becomes the executive director of the Office of
46	46	Rural Community Affairs in the Department of Agriculture;
47	47	(2) an employee of the Office of Rural Community
48	48	Affairs becomes an employee of the Office of Rural Community
49	49	Affairs in the Department of Agriculture;
50	50	(3) a reference in law to the Office of Rural Community
51	51	Affairs means the Office of Rural Community Affairs in the
52	52	Department of Agriculture;
53	53	(4) all money, contracts, leases, rights, and
54	54	obligations of the Office of Rural Community Affairs are
55	55	transferred to the Office of Rural Community Affairs in the
56	56	Department of Agriculture;
57	57	(5) all property, including records, in the custody of
58	58	the Office of Rural Community Affairs becomes the property of the
59	59	Office of Rural Community Affairs in the Department of Agriculture;
60	60	and
61	61	(6) all funds appropriated by the legislature to the
62	62	Office of Rural Community Affairs are transferred to the Office of
63	63	Rural Community Affairs in the Department of Agriculture.
64	64	SECTION 6. A function or activity performed by the Office of
65	65	Rural Community Affairs is transferred to the Office of Rural
66	66	Community Affairs in the Department of Agriculture as provided by
67	67	this Act.
68	68	SECTION 7. The Office of Rural Community Affairs and the
69	69	Department of Agriculture shall establish a transition plan for the
70	70	transfer described in Section 5 of this Act.
71	71	SECTION 8. This Act takes effect September 1, 2009.
