55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of state hotel occupancy tax revenue to clean
88 and maintain beaches in certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 156.2512(c)(1), Tax Code, is amended to
1111 read as follows:
1212 (1) "Eligible barrier island coastal municipality"
1313 means a municipality that is located wholly or partly on a barrier
1414 island and:
1515 (A) that borders on the Gulf of Mexico; or
1616 (B) [that is located wholly or partly on a
1717 barrier island; and
1818 [(C)] the boundaries of which [are within 30
1919 miles of the United Mexican States or] include a portion of a
2020 national seashore.
2121 SECTION 2. This Act takes effect on the first day of the
2222 first month beginning on or after the earliest date on which this
2323 Act may take effect if it receives a vote of two-thirds of all the
2424 members elected to each house, as provided by Section 39, Article
2525 III, Texas Constitution. If this Act does not receive the vote
2626 necessary for effect on that date, this Act takes effect September
2727 1, 2009.
