| 7 | 7 | relating to the use of state hotel occupancy tax revenue to clean | |
| 8 | 8 | and maintain beaches in certain municipalities. | |
| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 156.2512(c)(1), Tax Code, is amended to | |
| 11 | 11 | read as follows: | |
| 12 | 12 | (1) "Eligible barrier island coastal municipality" | |
| 13 | 13 | means a municipality that is located wholly or partly on a barrier | |
| 14 | 14 | island and: | |
| 15 | 15 | (A) that borders on the Gulf of Mexico; or | |
| 16 | 16 | (B) [that is located wholly or partly on a | |
| 17 | 17 | barrier island; and | |
| 18 | 18 | [(C)] the boundaries of which [are within 30 | |
| 19 | 19 | miles of the United Mexican States or] include a portion of a | |
| 20 | 20 | national seashore. | |
| 21 | 21 | SECTION 2. This Act takes effect on the first day of the | |
| 22 | 22 | first month beginning on or after the earliest date on which this | |
| 23 | 23 | Act may take effect if it receives a vote of two-thirds of all the | |
| 24 | 24 | members elected to each house, as provided by Section 39, Article | |
| 25 | 25 | III, Texas Constitution. If this Act does not receive the vote | |
| 26 | 26 | necessary for effect on that date, this Act takes effect September | |
| 27 | 27 | 1, 2009. |
