88 AN ACT
99 relating to grants for local areas adversely affected by a
1010 reduction in defense-related activity.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 486.002(b), Government Code, is amended
1313 to read as follows:
1414 (b) The commission shall establish criteria and procedures
1515 and award grants equitably based on evaluations. In awarding
1616 grants under this chapter, the commission shall give a preference
1717 to:
1818 (1) adversely affected defense communities over
1919 positively affected defense communities; and
2020 (2) any defense community with a population of less
2121 than 20,000.
2222 SECTION 2. Section 486.003(b), Government Code, is amended
2323 to read as follows:
2424 (b) A municipality or county is an adversely affected
2525 defense community if the department determines that:
2626 (1) the municipality or county includes within its
2727 boundaries a defense facility that the department of defense or
2828 applicable military department has publicly proposed for closure or
2929 realignment; or
3030 (2) the municipality or county:
3131 (A) requires assistance because of:
3232 (i) the proposed or actual establishment,
3333 realignment, or closure of a defense facility;
3434 (ii) the cancellation or termination of a
3535 United States Department of Defense contract or the failure of the
3636 department of defense to proceed with an approved major weapon
3737 system program;
3838 (iii) a publicly announced planned major
3939 reduction in department of defense spending that would directly and
4040 adversely affect the municipality or county; or
4141 (iv) the closure or a significant reduction
4242 of the operations of a defense facility as the result of a merger,
4343 acquisition, or consolidation of a defense contractor operating the
4444 facility; and
4545 (B) is expected to experience, during the period
4646 between the beginning of the federal fiscal year during which an
4747 event described by Subdivision (2)(A) is finally approved and the
4848 date that the event is to be substantially completed, a direct loss
4949 of:
5050 (i) 2,500 or more defense worker jobs in any
5151 area of the municipality or county that is located in an urbanized
5252 area of a metropolitan statistical area;
5353 (ii) 1,000 or more defense worker jobs in
5454 any area of the municipality or county that is not located in an
5555 urbanized area of a metropolitan statistical area; [or]
5656 (iii) defense worker jobs representing one
5757 percent of the jobs in the municipality or county; or
5858 (iv) tax or utility revenue as a result of
5959 the closure or realignment of a defense facility.
6060 SECTION 3. Section 486.004(a), Government Code, is amended
6161 to read as follows:
6262 (a) From money appropriated for this purpose, the
6363 commission may make a grant to an eligible local governmental
6464 entity to:
6565 (1) allow the entity to meet a matching money or
6666 investment requirement in order to receive from the United States
6767 assistance that is provided to allow the local governmental entity
6868 to respond to or recover from an event described by Section
6969 486.003(b)(1);
7070 (2) match the entity's contribution for a purpose
7171 described in Section 486.005 on a closed or realigned defense
7272 facility; [or]
7373 (3) plan or construct infrastructure and other
7474 projects necessary to accommodate the new or expanded military
7575 missions at a military facility located in or near the local
7676 governmental entity; or
7777 (4) offset tax or utility revenue lost by a
7878 municipality or county that is a defense community as a result of
7979 closure or realignment of a defense facility.
8080 SECTION 4. Section 486.005, Government Code, is amended by
8181 amending Subsection (a) and adding Subsection (d) to read as
8282 follows:
8383 (a) The local governmental entity may use the proceeds of
8484 the grant for:
8585 (1) purchase of property from the department of
8686 defense or its designated agent;
8787 (2) planning for redevelopment of a defense facility
8888 after closure or realignment;
8989 (3) [,] new construction, rehabilitation, or
9090 renovation of facilities or infrastructure;[,] or
9191 (4) purchase of capital equipment or facilities
9292 insurance.
9393 (d) A municipality or county that is a defense community may
9494 use the proceeds of the grant to offset tax or utility revenue lost
9595 by the municipality or county as a result of the closure or
9696 realignment of a defense facility.
9797 SECTION 5. Section 486.008, Government Code, is amended to
9898 read as follows:
9999 Sec. 486.008. EVALUATION OF APPLICATION. The panel shall
100100 evaluate each application and assign the applicant a score based
101101 on:
102102 (1) the significance of the adverse or positive effect
103103 within the local governmental entity, including:
104104 (A) the number of jobs [lost or gained in
105105 relation to the workforce] in the local governmental entity's
106106 jurisdiction that are directly or indirectly affected by the
107107 closure or realignment of a defense facility, considered as a
108108 percentage of the workforce in the local governmental entity's
109109 jurisdiction; and
110110 (B) the effect on the area's economy and tax and
111111 utility revenue;
112112 (2) the extent to which the local governmental entity
113113 has used its existing resources to promote local economic
114114 development;
115115 (3) the amount of any grant that the local
116116 governmental entity has previously received under this chapter;
117117 (4) the anticipated number of jobs to be created in
118118 relation to the amount of the grant sought; [and]
119119 (5) the extent to which the grant will affect the
120120 region in which the local governmental entity is located; and
121121 (6) the extent to which the grant is needed to offset
122122 tax or utility revenue lost by a municipality or county that is a
123123 defense community as a result of the closure or realignment of a
124124 defense facility.
125125 SECTION 6. This Act takes effect immediately if it receives
126126 a vote of two-thirds of all the members elected to each house, as
127127 provided by Section 39, Article III, Texas Constitution. If this
128128 Act does not receive the vote necessary for immediate effect, this
129129 Act takes effect September 1, 2009.
