66 AN ACT
77 relating to mandatory sales price disclosure in certain real
88 property sales; providing a civil penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 12, Property Code, is amended by adding
1111 Section 12.0012 to read as follows:
1212 Sec. 12.0012. MANDATORY SALES PRICE DISCLOSURE. (a) In
1313 this section:
1414 (1) "Commercial property" means real property that is
1515 primarily used in the course of a business that provides items or
1616 services for sale to the general public.
1717 (2) "Multifamily residential property" means real
1818 property that includes two or more residential units under single
1919 ownership.
2020 (3) "Vacant land" means unimproved real property.
2121 (b) A person may not file for record or have recorded in the
2222 county clerk's office an instrument conveying commercial property,
2323 multifamily residential property, or vacant land under a contract
2424 for sale unless the instrument discloses the sales price of the
2525 property.
2626 (c) The purchaser of any property for which an instrument is
2727 recorded in violation of Subsection (b) is liable to the state for a
2828 civil penalty for each violation in an amount equal to five percent
2929 of the sales price of the property.
3030 (d) The attorney general or the county or district attorney
3131 for the county in which the property is located may bring suit to
3232 recover a penalty under this section.
3333 (e) This section does not apply to an instrument conveying
3434 only a mineral interest in real property.
3535 SECTION 2. The changes in law made by this Act apply only to
3636 an instrument recorded on or after the effective date of this Act.
3737 An instrument recorded before the effective date of this Act is
3838 covered by the law in effect when the instrument was recorded, and
3939 the former law is continued in effect for that purpose.
4040 SECTION 3. This Act takes effect September 1, 2009.
