| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. The heading to Section 39.115, Education Code, |
|---|
| 9 | 9 | | is amended to read as follows: |
|---|
| 10 | 10 | | Sec. 39.115. [HIGH SCHOOL] INNOVATION GRANT INITIATIVE FOR |
|---|
| 11 | 11 | | MIDDLE, JUNIOR HIGH, AND HIGH SCHOOL CAMPUSES. |
|---|
| 12 | 12 | | SECTION 2. Sections 39.115(a), (b), and (d), Education |
|---|
| 13 | 13 | | Code, are amended to read as follows: |
|---|
| 14 | 14 | | (a) From funds appropriated for that purpose, the |
|---|
| 15 | 15 | | commissioner may establish a grant program under which grants are |
|---|
| 16 | 16 | | awarded to middle, junior high, and high school [secondary] |
|---|
| 17 | 17 | | campuses and school districts to support: |
|---|
| 18 | 18 | | (1) the implementation of innovative [high school] |
|---|
| 19 | 19 | | improvement programs that are based on the best available research |
|---|
| 20 | 20 | | regarding middle, junior high, or high school reform, dropout |
|---|
| 21 | 21 | | prevention, and preparing students for postsecondary coursework or |
|---|
| 22 | 22 | | employment; |
|---|
| 23 | 23 | | (2) enhancing education practices that have been |
|---|
| 24 | 24 | | demonstrated by significant evidence of effectiveness; and |
|---|
| 25 | 25 | | (3) the alignment of grants and programs to the |
|---|
| 26 | 26 | | strategic plan adopted under Section 39.357. |
|---|
| 27 | 27 | | (b) Before awarding a grant under this section, the |
|---|
| 28 | 28 | | commissioner may require a campus or school district to: |
|---|
| 29 | 29 | | (1) obtain local matching funds; or |
|---|
| 30 | 30 | | (2) meet other conditions, including developing a |
|---|
| 31 | 31 | | personal graduation plan under Section 28.0212 for each student |
|---|
| 32 | 32 | | enrolled at the campus or in a district middle, junior high, or high |
|---|
| 33 | 33 | | school. |
|---|
| 34 | 34 | | (d) The commissioner may use funds appropriated under this |
|---|
| 35 | 35 | | section to support technical assistance services for school |
|---|
| 36 | 36 | | districts and open-enrollment charter schools to implement an [a |
|---|
| 37 | 37 | | high school] improvement program under this section. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2009. |
