55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to permit application requirements for solid waste
88 facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 361.064, Health and Safety Code, is
1111 amended by adding Subsection (c) to read as follows:
1212 (c) A permit application under this subchapter must
1313 contain:
1414 (1) a certification from the applicant that the
1515 applicant has mailed to each resident living one mile or less from
1616 the site and each community organization, nonprofit organization,
1717 or civic club located two miles or less from the site:
1818 (A) an explanation of the site's proposed
1919 operations; and
2020 (B) a questionnaire seeking community comments
2121 regarding the site's proposed operations; and
2222 (2) any comments made by residents, organizations, or
2323 clubs in response to the questionnaire.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an application for a permit that is submitted to the Texas
2626 Commission on Environmental Quality on or after the effective date
2727 of this Act. An application for a permit that was submitted to the
2828 Texas Commission on Environmental Quality before the effective date
2929 of this Act is governed by the law in effect at the time the
3030 application was filed, and the former law is continued in effect for
3131 that purpose.
3232 SECTION 3. This Act takes effect September 1, 2009.
