9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 361.064, Health and Safety Code, is | |
11 | 11 | amended by adding Subsection (c) to read as follows: | |
12 | 12 | (c) A permit application under this subchapter must | |
13 | 13 | contain: | |
14 | 14 | (1) a certification from the applicant that the | |
15 | 15 | applicant has mailed to each resident living one mile or less from | |
16 | 16 | the site and each community organization, nonprofit organization, | |
17 | 17 | or civic club located two miles or less from the site: | |
18 | 18 | (A) an explanation of the site's proposed | |
19 | 19 | operations; and | |
20 | 20 | (B) a questionnaire seeking community comments | |
21 | 21 | regarding the site's proposed operations; and | |
22 | 22 | (2) any comments made by residents, organizations, or | |
23 | 23 | clubs in response to the questionnaire. | |
24 | 24 | SECTION 2. The change in law made by this Act applies only | |
25 | 25 | to an application for a permit that is submitted to the Texas | |
26 | 26 | Commission on Environmental Quality on or after the effective date | |
27 | 27 | of this Act. An application for a permit that was submitted to the | |
28 | 28 | Texas Commission on Environmental Quality before the effective date | |
29 | 29 | of this Act is governed by the law in effect at the time the | |
30 | 30 | application was filed, and the former law is continued in effect for | |
31 | 31 | that purpose. | |
32 | 32 | SECTION 3. This Act takes effect September 1, 2009. |
