9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 1702.104(b), Occupations Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (b) For purposes of Subsection (a)(1), "obtaining | |
13 | 13 | [obtaining] or furnishing information" [information] includes | |
14 | 14 | information obtained or furnished through the review and analysis | |
15 | 15 | of, and the investigation into the content of, computer-based data | |
16 | 16 | not available to the public. For purposes of Subsection (a)(1), | |
17 | 17 | "obtaining or furnishing information" does not include information | |
18 | 18 | obtained or furnished by an information technology professional | |
19 | 19 | who: | |
20 | 20 | (1) is installing or repairing a person's computer | |
21 | 21 | equipment for the person or is examining the cause for the required | |
22 | 22 | repair; and | |
23 | 23 | (2) is not performing any other act that requires a | |
24 | 24 | license under this chapter. | |
25 | 25 | SECTION 2. This Act takes effect immediately if it receives | |
26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
29 | 29 | Act takes effect September 1, 2009. |
