77 relating to an exemption from investigation company license
88 requirements for certain information technology professionals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1702.104(b), Occupations Code, is
1111 amended to read as follows:
1212 (b) For purposes of Subsection (a)(1), "obtaining
1313 [obtaining] or furnishing information" [information] includes
1414 information obtained or furnished through the review and analysis
1515 of, and the investigation into the content of, computer-based data
1616 not available to the public. For purposes of Subsection (a)(1),
1717 "obtaining or furnishing information" does not include information
1818 obtained or furnished by an information technology professional
1919 who:
2020 (1) is installing or repairing a person's computer
2121 equipment for the person or is examining the cause for the required
2222 repair; and
2323 (2) is not performing any other act that requires a
2424 license under this chapter.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2009.
