66 AN ACT
77 relating to civil liability for selling or serving alcoholic
88 beverages.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 33.002(c), Civil Practice and Remedies
1111 Code, is amended to read as follows:
1212 (c) This chapter does not apply to:
1313 (1) an action to collect workers' compensation
1414 benefits under the workers' compensation laws of this state
1515 (Subtitle A, Title 5, Labor Code) or actions against an employer
1616 for exemplary damages arising out of the death of an employee;
1717 (2) a claim for exemplary damages included in an
1818 action to which this chapter otherwise applies; [or]
1919 (3) a cause of action for damages arising from the
2020 manufacture of methamphetamine as described by Chapter 99; or
2121 (4) an action under Chapter 2, Alcoholic Beverage
2222 Code.
2323 SECTION 2. The change in law made by this Act applies only
2424 to a cause of action that accrues on or after the effective date of
2525 this Act. A cause of action that accrues before the effective date
2626 of this Act is governed by the law in effect immediately before the
2727 effective date of this Act, and that law is continued in effect for
2828 that purpose.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
