| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 33.002(c), Civil Practice and Remedies |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | (c) This chapter does not apply to: |
|---|
| 13 | 13 | | (1) an action to collect workers' compensation |
|---|
| 14 | 14 | | benefits under the workers' compensation laws of this state |
|---|
| 15 | 15 | | (Subtitle A, Title 5, Labor Code) or actions against an employer |
|---|
| 16 | 16 | | for exemplary damages arising out of the death of an employee; |
|---|
| 17 | 17 | | (2) a claim for exemplary damages included in an |
|---|
| 18 | 18 | | action to which this chapter otherwise applies; [or] |
|---|
| 19 | 19 | | (3) a cause of action for damages arising from the |
|---|
| 20 | 20 | | manufacture of methamphetamine as described by Chapter 99; or |
|---|
| 21 | 21 | | (4) an action under Chapter 2, Alcoholic Beverage |
|---|
| 22 | 22 | | Code. |
|---|
| 23 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 24 | 24 | | to a cause of action that accrues on or after the effective date of |
|---|
| 25 | 25 | | this Act. A cause of action that accrues before the effective date |
|---|
| 26 | 26 | | of this Act is governed by the law in effect immediately before the |
|---|
| 27 | 27 | | effective date of this Act, and that law is continued in effect for |
|---|
| 28 | 28 | | that purpose. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2009. |
