55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a defendant's payment of the costs of legal services
88 provided by court-appointed counsel in a criminal case.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 26.05(g), Code of Criminal Procedure, is
1111 amended to read as follows:
1212 (g) If the court determines that a defendant has financial
1313 resources that enable him to offset in part or in whole the costs of
1414 the legal services provided, including any expenses and costs, the
1515 court shall order the defendant to pay [during the pendency of the
1616 charges or, if convicted, as court costs] the amount that it finds
1717 the defendant is able to pay.
1818 SECTION 2. This Act applies to a criminal proceeding that
1919 commences on or after the effective date of this Act. A criminal
2020 proceeding that commenced before the effective date of this Act is
2121 governed by the law in effect at the time the proceeding commenced,
2222 and the former law is continued in effect for that purpose.
2323 SECTION 3. This Act takes effect September 1, 2009.
