9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Article 26.05(g), Code of Criminal Procedure, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (g) If the court determines that a defendant has financial | |
13 | 13 | resources that enable him to offset in part or in whole the costs of | |
14 | 14 | the legal services provided, including any expenses and costs, the | |
15 | 15 | court shall order the defendant to pay [during the pendency of the | |
16 | 16 | charges or, if convicted, as court costs] the amount that it finds | |
17 | 17 | the defendant is able to pay. | |
18 | 18 | SECTION 2. This Act applies to a criminal proceeding that | |
19 | 19 | commences on or after the effective date of this Act. A criminal | |
20 | 20 | proceeding that commenced before the effective date of this Act is | |
21 | 21 | governed by the law in effect at the time the proceeding commenced, | |
22 | 22 | and the former law is continued in effect for that purpose. | |
23 | 23 | SECTION 3. This Act takes effect September 1, 2009. |
