| 5 | 5 | | relating to coverage under a meet and confer agreement for certain |

| 6 | 6 | | municipal firefighters and police officers. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 147.002, Local Government Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | Sec. 147.002. DEFINITIONS. In this chapter: |
|---|
| 11 | 11 | | (1) "Firefighter" means a firefighter employed by the |
|---|
| 12 | 12 | | municipality who is covered by the municipality's fire pension plan |
|---|
| 13 | 13 | | and is classified by the municipality as nonexempt [exempt]. The |
|---|
| 14 | 14 | | term does not include a firefighter with a rank that is above that |
|---|
| 15 | 15 | | of battalion chief or section chief. |
|---|
| 16 | 16 | | (2) "Firefighter employee group" means an |
|---|
| 17 | 17 | | organization: |
|---|
| 18 | 18 | | (A) in which, on or before September 1, 2007, |
|---|
| 19 | 19 | | firefighters of the municipality have participated and paid dues |
|---|
| 20 | 20 | | via automatic payroll deduction [for at least one year]; and |
|---|
| 21 | 21 | | (B) that exists for the purpose, in whole or in |
|---|
| 22 | 22 | | part, of dealing with the municipality concerning grievances, labor |
|---|
| 23 | 23 | | disputes, wages, rates of pay, hours of employment, or conditions |
|---|
| 24 | 24 | | of employment affecting firefighters. |
|---|
| 25 | 25 | | (3) "Police officer" means a sworn police officer |
|---|
| 26 | 26 | | employed by the municipality who is covered by the municipality's |
|---|
| 27 | 27 | | police pension plan and is classified by the municipality as |
|---|
| 28 | 28 | | nonexempt [exempt]. The term does not include a police officer with |
|---|
| 29 | 29 | | a rank above that of captain, a civilian, or a municipal marshal. |
|---|
| 30 | 30 | | (4) "Police officer employee group" means an |
|---|
| 31 | 31 | | organization: |
|---|
| 32 | 32 | | (A) in which, on or before September 1, 2007, at |
|---|
| 33 | 33 | | least three percent of the police officers of the municipality have |
|---|
| 34 | 34 | | participated and paid dues via automatic payroll deduction [for at |
|---|
| 35 | 35 | | least one year]; and |
|---|
| 36 | 36 | | (B) that exists for the purpose, in whole or in |
|---|
| 37 | 37 | | part, of dealing with the municipality concerning grievances, labor |
|---|
| 38 | 38 | | disputes, wages, rates of pay, hours of employment, or conditions |
|---|
| 39 | 39 | | of employment affecting police officers. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2009. |
