55 relating to coverage under a meet and confer agreement for certain
66 municipal firefighters and police officers.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 147.002, Local Government Code, is
99 amended to read as follows:
1010 Sec. 147.002. DEFINITIONS. In this chapter:
1111 (1) "Firefighter" means a firefighter employed by the
1212 municipality who is covered by the municipality's fire pension plan
1313 and is classified by the municipality as nonexempt [exempt]. The
1414 term does not include a firefighter with a rank that is above that
1515 of battalion chief or section chief.
1616 (2) "Firefighter employee group" means an
1717 organization:
1818 (A) in which, on or before September 1, 2007,
1919 firefighters of the municipality have participated and paid dues
2020 via automatic payroll deduction [for at least one year]; and
2121 (B) that exists for the purpose, in whole or in
2222 part, of dealing with the municipality concerning grievances, labor
2323 disputes, wages, rates of pay, hours of employment, or conditions
2424 of employment affecting firefighters.
2525 (3) "Police officer" means a sworn police officer
2626 employed by the municipality who is covered by the municipality's
2727 police pension plan and is classified by the municipality as
2828 nonexempt [exempt]. The term does not include a police officer with
2929 a rank above that of captain, a civilian, or a municipal marshal.
3030 (4) "Police officer employee group" means an
3131 organization:
3232 (A) in which, on or before September 1, 2007, at
3333 least three percent of the police officers of the municipality have
3434 participated and paid dues via automatic payroll deduction [for at
3535 least one year]; and
3636 (B) that exists for the purpose, in whole or in
3737 part, of dealing with the municipality concerning grievances, labor
3838 disputes, wages, rates of pay, hours of employment, or conditions
3939 of employment affecting police officers.
4040 SECTION 2. This Act takes effect September 1, 2009.
