99 relating to the creation of a rural economic development and
1010 investment program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. This Act shall be known as the Rural Economic
1313 Development and Investment Act.
1414 SECTION 2. Chapter 12, Agriculture Code, is amended by
1515 adding Section 12.0271 to read as follows:
1616 Sec. 12.0271. RURAL ECONOMIC DEVELOPMENT AND INVESTMENT
1717 PROGRAM. (a) From funds appropriated for that purpose, the
1818 commissioner shall establish and administer a financial assistance
1919 program to encourage private economic development in rural areas.
2020 Financial assistance under the program may be provided only to:
2121 (1) a county with a population of not more than 75,000;
2222 or
2323 (2) a municipality with a population of not more than
2424 50,000.
2525 (b) Financial assistance under Subsection (a) may be used
2626 only for a project relating to:
2727 (1) the acquisition or development of land, easements,
2828 or rights-of-way;
2929 (2) attracting new private enterprises to the county
3030 or municipality, including:
3131 (A) manufacturing facilities;
3232 (B) freight storage facilities;
3333 (C) distribution warehouse centers; and
3434 (D) other nonretail private enterprises;
3535 (3) the construction, extension, or other improvement
3636 of:
3737 (A) water or waste disposal facilities; or
3838 (B) transportation infrastructure; or
3939 (4) any other activity relating to private economic
4040 development that the commissioner determines will encourage
4141 economic and infrastructure development in a rural area.
4242 (c) To further a purpose described by Subsection (b), the
4343 commissioner may provide financial assistance to an eligible county
4444 or municipality by:
4545 (1) extending credit by direct loan, based on the
4646 credit of the county or municipality;
4747 (2) providing a credit enhancement;
4848 (3) effectively lowering interest rates;
4949 (4) financing a purchase or lease agreement in
5050 connection with an economic or infrastructure development project;
5151 or
5252 (5) providing methods of leveraging money that have
5353 been approved by a federal cabinet-level agency and relate to the
5454 project for which the assistance is provided.
5555 (d) A county or municipality that receives funds under
5656 Subsection (c) shall segregate the funds from other funds under the
5757 control of the county or municipality and use the funds only for a
5858 purpose described by this section. Any funds disbursed through the
5959 program must be repaid on terms determined by the department.
6060 (e) The department shall adopt rules necessary to implement
6161 this section.
6262 SECTION 3. This Act takes effect September 1, 2009.
