 AN ACT
 relating to the designation of the Texas Department of
 Transportation as the contracting agent for certain airports.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 22.018, Transportation Code, is amended
 to read as follows:
 Sec. 22.018. DESIGNATION OF TEXAS DEPARTMENT OF
 TRANSPORTATION AS AGENT IN CONTRACTING AND SUPERVISING. (a) A
 local government or an owner of an eligible airport may designate
 the Texas Department of Transportation as its agent in contracting
 for and supervising the planning, acquiring, constructing,
 improving, equipping, maintaining, or operating of an airport or
 air navigation facility.
 (b) A local government or an owner of an eligible airport
 may enter into an agreement with the department prescribing the
 terms of the agency relationship in accordance with the terms
 prescribed by the United States, if federal money is involved, and
 in accordance with the laws of this state.
 (c) The department, in acting as the agent of a local
 government or an owner of an eligible airport under this section,
 shall make each contract in accordance with the law governing the
 making of contracts by or on behalf of the state.
 (d)  In this section, "eligible airport" means an airport
 eligible to receive grant funds under the airport improvement
 program established by 49 U.S.C. Section 47101 et seq.
 SECTION 2. This Act takes effect September 1, 2009.
