99 relating to the appointment of a county auditor in certain
1010 counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 84.002, Local Government Code, is
1313 amended to read as follows:
1414 Sec. 84.002. APPOINTMENT OF COUNTY AUDITOR. (a) In a
1515 county with a population of 12,000 [10,200] or more, the district
1616 judges shall appoint a county auditor.
1717 (b) In a county with a population of less than 12,000
1818 [10,200]:
1919 (1) the district judges may appoint a county auditor
2020 if the judges determine that the county's financial circumstances
2121 warrant the appointment; and
2222 (2) the district judges shall appoint a county auditor
2323 if:
2424 (A) the commissioners court finds that a county
2525 auditor is necessary to carry out county business and enters an
2626 order in its minutes stating the reason for this finding;
2727 (B) the order is certified to the district
2828 judges; and
2929 (C) the district judges find the reason stated by
3030 the commissioners court to be good and sufficient.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2009.
