77 relating to notice requirements before cancellation of certain
88 insurance coverage.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 5, Insurance Code, is amended
1111 by adding Chapter 561 to read as follows:
1212 CHAPTER 561. NOTICE REQUIRED BEFORE CANCELLATION OF CERTAIN
1313 INSURANCE COVERAGE
1414 Sec. 561.001. DEFINITIONS. In this chapter:
1515 (1) "Personal automobile insurance" means motor
1616 vehicle insurance coverage for the ownership, maintenance, or use
1717 of a private passenger, utility, or miscellaneous type motor
1818 vehicle, including a motor home, trailer, or recreational vehicle,
1919 that is:
2020 (A) owned or leased by one or more individuals;
2121 and
2222 (B) not used primarily for the delivery of goods,
2323 materials, or services, other than for use in farm or ranch
2424 operations.
2525 (2) "Personal lines insurance" means an insurance
2626 policy or contract that is issued to an insurance consumer. The
2727 term includes:
2828 (A) personal automobile insurance;
2929 (B) residential property insurance;
3030 (C) a whole life or term life insurance policy
3131 issued to an insurance consumer; and
3232 (D) an individual health insurance policy.
3333 (3) "Residential property insurance" means insurance
3434 coverage against loss to real or tangible personal property at a
3535 fixed location that is provided through:
3636 (A) a homeowners policy, including a tenants
3737 policy;
3838 (B) a condominium owners policy; or
3939 (C) a residential fire and allied lines policy.
4040 Sec. 561.002. APPLICABILITY. This chapter applies to each
4141 policy or contract of personal lines insurance that is delivered,
4242 issued for delivery, or renewed in this state.
4343 Sec. 561.003. NOTIFICATION REGARDING CANCELLATION. (a)
4444 Notwithstanding any other law, an insurer that delivers, issues for
4545 delivery, or renews a policy or contract of personal lines
4646 insurance in this state shall notify the policyholder of
4747 cancellation of the policy or contract through a written statement
4848 delivered by certified mail. Any notice concerning cancellation of
4949 a personal lines insurance policy or contract required by any other
5050 provision of this code or commissioner rule must comply with this
5151 section.
5252 (b) An insurer that violates Subsection (a) commits an
5353 unfair or deceptive act or practice in the business of insurance
5454 under Chapter 541.
5555 Sec. 561.004. RULES. The commissioner shall adopt rules as
5656 necessary to implement this chapter.
5757 SECTION 2. This Act applies only to an insurance policy or
5858 contract that is delivered, issued for delivery, or renewed on or
5959 after January 1, 2010. A policy or contract delivered, issued for
6060 delivery, or renewed before January 1, 2010, is governed by the law
6161 as it existed immediately before the effective date of this Act, and
6262 that law is continued in effect for that purpose.
6363 SECTION 3. This Act takes effect September 1, 2009.
