8	8	relating to employment at or by certain facilities serving the
9	9	elderly or person with disabilities.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 250.006(a), Health and Safety Code, is
12	12	amended to read as follows:
13	13	(a) A person for whom the facility is entitled to obtain
14	14	criminal history record information may not be employed in a
15	15	facility if the person has been convicted of an offense listed in
16	16	this subsection:
17	17	(1) an offense under Chapter 19, Penal Code (criminal
18	18	homicide);
19	19	(2) an offense under Chapter 20, Penal Code
20	20	(kidnapping and unlawful restraint);
21	21	(3) an offense under Section 21.02, Penal Code
22	22	(continuous sexual abuse of young child or children), or Section
23	23	21.11, Penal Code (indecency with a child);
24	24	(4) an offense under Section 22.011, Penal Code
25	25	(sexual assault);
26	26	(5) an offense under Section 22.02, Penal Code
27	27	(aggravated assault);
28	28	(6) an offense under Section 22.04, Penal Code (injury
29	29	to a child, elderly individual, or disabled individual);
30	30	(7) an offense under Section 22.041, Penal Code
31	31	(abandoning or endangering child);
32	32	(8) an offense under Section 22.08, Penal Code (aiding
33	33	suicide);
34	34	(9) an offense under Section 25.031, Penal Code
35	35	(agreement to abduct from custody);
36	36	(10) an offense under Section 25.08, Penal Code (sale
37	37	or purchase of a child);
38	38	(11) an offense under Section 28.02, Penal Code
39	39	(arson);
40	40	(12) an offense under Section 29.02, Penal Code

69	69	elements of an offense listed by this subsection.
70	70	SECTION 2. The heading to Chapter 253, Health and Safety
71	71	Code, is amended to read as follows:
72	72	CHAPTER 253. CERTAIN EMPLOYEE MISCONDUCT; REGISTRY
73	73	SECTION 3. Section 253.001(5), Health and Safety Code, is
74	74	amended to read as follows:
75	75	(5) "Reportable conduct" includes:
76	76	(A) abuse or neglect that causes or may cause
77	77	death or harm to a resident or consumer of a facility;
78	78	(B) sexual abuse of a resident or consumer of a
79	79	facility;
80	80	(C) financial exploitation of a resident or
81	81	consumer of a facility in an amount of $25 or more; [and]
82	82	(D) emotional, verbal, or psychological abuse
83	83	that causes harm to a resident or consumer of a facility; and
84	84	(E) solicitation of a gift from a resident or
85	85	consumer of a facility.
86	86	SECTION 4. This Act takes effect September 1, 2009.
