1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 250.006(a), Health and Safety Code, is
1212 amended to read as follows:
1313 (a) A person for whom the facility is entitled to obtain
1414 criminal history record information may not be employed in a
1515 facility if the person has been convicted of an offense listed in
1616 this subsection:
1717 (1) an offense under Chapter 19, Penal Code (criminal
1818 homicide);
1919 (2) an offense under Chapter 20, Penal Code
2020 (kidnapping and unlawful restraint);
2121 (3) an offense under Section 21.02, Penal Code
2222 (continuous sexual abuse of young child or children), or Section
2323 21.11, Penal Code (indecency with a child);
2424 (4) an offense under Section 22.011, Penal Code
2525 (sexual assault);
2626 (5) an offense under Section 22.02, Penal Code
2727 (aggravated assault);
2828 (6) an offense under Section 22.04, Penal Code (injury
2929 to a child, elderly individual, or disabled individual);
3030 (7) an offense under Section 22.041, Penal Code
3131 (abandoning or endangering child);
3232 (8) an offense under Section 22.08, Penal Code (aiding
3333 suicide);
3434 (9) an offense under Section 25.031, Penal Code
3535 (agreement to abduct from custody);
3636 (10) an offense under Section 25.08, Penal Code (sale
3737 or purchase of a child);
3838 (11) an offense under Section 28.02, Penal Code

6868 offense containing elements that are substantially similar to the
6969 elements of an offense listed by this subsection.
7070 SECTION 2. The heading to Chapter 253, Health and Safety
7171 Code, is amended to read as follows:
7272 CHAPTER 253. CERTAIN EMPLOYEE MISCONDUCT; REGISTRY
7373 SECTION 3. Section 253.001(5), Health and Safety Code, is
7474 amended to read as follows:
7575 (5) "Reportable conduct" includes:
7676 (A) abuse or neglect that causes or may cause
7777 death or harm to a resident or consumer of a facility;
7878 (B) sexual abuse of a resident or consumer of a
7979 facility;
8080 (C) financial exploitation of a resident or
8181 consumer of a facility in an amount of $25 or more; [and]
8282 (D) emotional, verbal, or psychological abuse
8383 that causes harm to a resident or consumer of a facility; and
8484 (E) solicitation of a gift from a resident or
8585 consumer of a facility.
8686 SECTION 4. This Act takes effect September 1, 2009.
