55 relating to the creation of an advisory committee to establish and
66 recommend qualifications for certain health care translators and
77 interpreters.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 531, Government Code, is amended by
1010 adding Subchapter R to read as follows:
1111 SUBCHAPTER R. ADVISORY COMMITTEE ON QUALIFICATIONS FOR
1212 HEALTH CARE TRANSLATORS AND INTERPRETERS
1313 Sec. 531.701. DEFINITIONS. In this subchapter:
1414 (1) "Advisory committee" means the Advisory Committee
1515 on Qualifications for Health Care Translators and Interpreters.
1616 (2) "Health care" means medical care, surgical care,
1717 hospital care, or any remedial care provided to diagnose, prevent,
1818 alleviate, or cure a patient's injury or illness, including mental
1919 health care.
2020 (3) "Health care interpreter" means a person who is
2121 trained to communicate with a person who has limited English
2222 proficiency or who is deaf or hard of hearing by accurately
2323 conveying in English and the language of the person who has limited
2424 English proficiency or who is deaf or hard of hearing the meaning of
2525 health care related statements made orally.
2626 (4) "Health care practitioner" means an individual who
2727 furnishes patient health care services under a license,
2828 certificate, or registration issued by this state.
2929 (5) "Health care translator" means a person who is
3030 trained to communicate in writing with a person with limited
3131 English proficiency by accurately translating into English and the
3232 language of the person who has limited English proficiency written
3333 health care related statements.
3434 (6) "Person who has limited English proficiency" means
3535 a person who:
3636 (A) because of the person's place of birth or
3737 culture, speaks a language other than English; and
3838 (B) does not speak English adequately to
3939 communicate effectively with a health care practitioner.
4040 Sec. 531.702. APPLICABILITY OF OTHER LAW. Except as
4141 otherwise provided by this subchapter or a rule adopted by the
4242 executive commissioner, the advisory committee is subject to
4343 Chapter 2110.
4444 Sec. 531.703. APPLICATION OF SUNSET ACT. The Advisory
4545 Committee on Qualifications for Health Care Translators and
4646 Interpreters is subject to Chapter 325 (Texas Sunset Act). Unless
4747 continued in existence as provided by this subchapter, the
4848 committee is abolished and this subchapter expires January 1, 2021.
4949 Sec. 531.704. ESTABLISHMENT. The executive commissioner
5050 shall establish the Advisory Committee on Qualifications for Health
5151 Care Translators and Interpreters.
5252 Sec. 531.705. MEMBERS. (a) The advisory committee is
5353 composed of not fewer than 10 members appointed by the executive
5454 commissioner as provided by this section.
5555 (b) The advisory committee must include:
5656 (1) one member who is a representative of a
5757 professional translators and interpreters association;
5858 (2) one member who is a health care interpreter
5959 working with people who have limited English proficiency;
6060 (3) one member who is a health care interpreter
6161 working with people who are deaf or hard of hearing;
6262 (4) one member who is a representative of a mental
6363 health services provider;
6464 (5) one member who is a representative of a hospital;
6565 (6) one member who represents the insurance industry;
6666 (7) one member who represents a business entity that
6767 provides translators and interpreters to health care
6868 practitioners;
6969 (8) one member who represents an organization that
7070 provides services to immigrants and refugees; and
7171 (9) one member who is a representative of an
7272 institution of higher education.
7373 (c) The remaining members of the advisory committee must
7474 include at least one health care practitioner and additional
7575 members, as determined by the executive commissioner, who represent
7676 the interests of consumers.
7777 Sec. 531.706. DUTIES. (a) The advisory committee shall
7878 establish and recommend qualifications for health care
7979 interpreters and health care translators that include:
8080 (1) for a person to be qualified as a health care
8181 translator, requiring the person to:
8282 (A) fluently understand a written foreign
8383 language and demonstrate the ability to accurately translate
8484 messages communicated in that language into English and to
8585 accurately translate messages communicated in English into that
8686 language; and
8787 (B) have practical experience as a translator or
8888 hold professional certification as a translator; and
8989 (2) for a person to be qualified as a health care
9090 interpreter, requiring the person to:
9191 (A) fluently understand a spoken foreign
9292 language and demonstrate the ability to accurately interpret
9393 messages communicated in that language into English and to
9494 interpret messages communicated in English into that language; and
9595 (B) have practical experience as an interpreter
9696 or hold professional certification or licensure as an interpreter.
9797 (b) The advisory committee shall advise the commission on:
9898 (1) the language proficiency required for
9999 certification as a health care interpreter or health care
100100 translator;
101101 (2) training requirements for health care
102102 interpreters and health care translators;
103103 (3) standards of practice for health care interpreters
104104 and health care translators;
105105 (4) the requirements, content, and administration of
106106 certification examinations for health care interpreters and health
107107 care translators;
108108 (5) the procedures for testing, qualifying, and
109109 certifying health care interpreters and health care translators;
110110 and
111111 (6) reciprocity agreements with other states.
112112 (c) The advisory committee shall:
113113 (1) develop strategies for implementing the
114114 regulation of health care interpreters and health care translators;
115115 (2) make recommendations to the commission for any
116116 legislation necessary to establish and enforce qualifications for
117117 health care interpreters and health care translators or for the
118118 adoption of rules by state agencies regulating health care
119119 practitioners, hospitals, physician offices, and health care
120120 facilities that hire health care interpreters or health care
121121 translators; and
122122 (3) perform other activities assigned by the
123123 commission related to health care interpreters or health care
124124 translators.
125125 Sec. 531.707. COMPENSATION; REIMBURSEMENT. A member of the
126126 advisory committee may not receive compensation, but is entitled to
127127 reimbursement of the travel expenses incurred by the member while
128128 conducting the business of the advisory committee, as provided by
129129 the General Appropriations Act.
130130 SECTION 2. Not later than January 1, 2010, the executive
131131 commissioner of the Health and Human Services Commission shall
132132 establish the Advisory Committee on Qualifications for Health Care
133133 Translators and Interpreters as required by Subchapter R, Chapter
134134 531, Government Code, as added by this Act.
135135 SECTION 3. This Act takes effect September 1, 2009.
