55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the penalties prescribed for committing prostitution
88 within a certain distance of certain designated places.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 43.01, Penal Code, is amended by adding
1111 Subdivision (2-a) to read as follows:
1212 (2-a) "Protected premises" means the real property and
1313 all buildings and appurtenances pertaining to the real property of:
1414 (A) an agency of the state or a political
1515 subdivision of the state;
1616 (B) a church;
1717 (C) a public or private school;
1818 (D) a licensed child-care facility;
1919 (E) a public park; or
2020 (F) the premises of the holder of a license or
2121 permit issued under Title 3, Alcoholic Beverage Code.
2222 SECTION 2. Section 43.02, Penal Code, is amended by adding
2323 Subsection (d) to read as follows:
2424 (d) If it is shown on the trial of the offense that the actor
2525 committed the offense within 1,000 feet of a protected premises,
2626 the offense is:
2727 (1) a Class A misdemeanor if the offense would
2828 otherwise be punishable as a Class B misdemeanor under Subsection
2929 (c);
3030 (2) a state jail felony if the offense would otherwise
3131 be punishable as a Class A misdemeanor under Subsection (c); and
3232 (3) a felony of the third degree if the offense would
3333 otherwise be punishable as a state jail felony under Subsection
3434 (c).
3535 SECTION 3. Section 43.03(b), Penal Code, is amended to read
3636 as follows:
3737 (b) An offense under this section is a Class A misdemeanor,
3838 unless it is shown on the trial of the offense that the actor
3939 committed the offense within 1,000 feet of a protected premises, in
4040 which event the offense is a state jail felony.
4141 SECTION 4. The change in law made by this Act applies only
4242 to an offense committed on or after the effective date of this Act.
4343 An offense committed before the effective date of this Act is
4444 covered by the law in effect when the offense was committed, and the
4545 former law is continued in effect for that purpose. For purposes of
4646 this section, an offense was committed before the effective date of
4747 this Act if any element of the offense was committed before that
4848 date.
4949 SECTION 5. This Act takes effect September 1, 2009.
