66 AN ACT
77 relating to fees charged for issuance by a state or local
88 governmental entity of identification that may be presented to be
99 accepted to vote.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 63.0101, Election Code, is amended to
1212 read as follows:
1313 Sec. 63.0101. DOCUMENTATION OF PROOF OF IDENTIFICATION.
1414 (a) The following documentation is acceptable as proof of
1515 identification under this chapter:
1616 (1) a driver's license or personal identification card
1717 issued to the person by the Department of Public Safety or a similar
1818 document issued to the person by an agency of another state,
1919 regardless of whether the license or card has expired;
2020 (2) a form of identification containing the person's
2121 photograph that establishes the person's identity;
2222 (3) a birth certificate or other document confirming
2323 birth that is admissible in a court of law and establishes the
2424 person's identity;
2525 (4) United States citizenship papers issued to the
2626 person;
2727 (5) a United States passport issued to the person;
2828 (6) official mail addressed to the person by name from
2929 a governmental entity;
3030 (7) a copy of a current utility bill, bank statement,
3131 government check, paycheck, or other government document that shows
3232 the name and address of the voter; or
3333 (8) any other form of identification prescribed by the
3434 secretary of state.
3535 (b) Notwithstanding any other law, a state or local
3636 governmental entity may not charge a fee for the issuance of a
3737 document that a person may present as proof of identification in
3838 order for the person to be accepted for voting.
3939 SECTION 2. This Act takes effect September 1, 2009.
