| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 63.0101, Election Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | Sec. 63.0101. DOCUMENTATION OF PROOF OF IDENTIFICATION. |
|---|
| 14 | 14 | | (a) The following documentation is acceptable as proof of |
|---|
| 15 | 15 | | identification under this chapter: |
|---|
| 16 | 16 | | (1) a driver's license or personal identification card |
|---|
| 17 | 17 | | issued to the person by the Department of Public Safety or a similar |
|---|
| 18 | 18 | | document issued to the person by an agency of another state, |
|---|
| 19 | 19 | | regardless of whether the license or card has expired; |
|---|
| 20 | 20 | | (2) a form of identification containing the person's |
|---|
| 21 | 21 | | photograph that establishes the person's identity; |
|---|
| 22 | 22 | | (3) a birth certificate or other document confirming |
|---|
| 23 | 23 | | birth that is admissible in a court of law and establishes the |
|---|
| 24 | 24 | | person's identity; |
|---|
| 25 | 25 | | (4) United States citizenship papers issued to the |
|---|
| 26 | 26 | | person; |
|---|
| 27 | 27 | | (5) a United States passport issued to the person; |
|---|
| 28 | 28 | | (6) official mail addressed to the person by name from |
|---|
| 29 | 29 | | a governmental entity; |
|---|
| 30 | 30 | | (7) a copy of a current utility bill, bank statement, |
|---|
| 31 | 31 | | government check, paycheck, or other government document that shows |
|---|
| 32 | 32 | | the name and address of the voter; or |
|---|
| 33 | 33 | | (8) any other form of identification prescribed by the |
|---|
| 34 | 34 | | secretary of state. |
|---|
| 35 | 35 | | (b) Notwithstanding any other law, a state or local |
|---|
| 36 | 36 | | governmental entity may not charge a fee for the issuance of a |
|---|
| 37 | 37 | | document that a person may present as proof of identification in |
|---|
| 38 | 38 | | order for the person to be accepted for voting. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect September 1, 2009. |
