6	6	AN ACT
7	7	relating to the salary paid to certain professional employees of
8	8	public schools.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 21.402, Education Code, is amended by
11	11	amending Subsections (c) and (d) and adding Subsections (c-1) and
12	12	(c-2) to read as follows:

32	32	(c-1) Notwithstanding Subsection (a), for the 2009-2010
33	33	school year, a classroom teacher, full-time librarian, full-time
34	34	counselor certified under Subchapter B, or full-time school nurse
35	35	is entitled to a monthly salary that is at least equal to the sum of:
36	36	(1) the monthly salary the employee would have
37	37	received for the 2009-2010 school year under the district's salary
38	38	schedule for the 2008-2009 school year, if that schedule had been in
39	39	effect for the 2009-2010 school year, including any local
40	40	supplement and any money representing a career ladder supplement
41	41	the employee would have received in the 2009-2010 school year; and
42	42	(2) $300.
43	43	(c-2) Subsection (c-1) and this subsection expire September
44	44	1, 2010.
45	45	(d) A classroom teacher, full-time librarian, full-time
46	46	counselor certified under Subchapter B, or full-time school nurse
47	47	employed by a school district in the 2009-2010 [2006-2007] school
48	48	year is, as long as the employee is employed by the same district,
49	49	entitled to a salary that is at least equal to the salary the
50	50	employee received for the 2009-2010 [2006-2007] school year.
51	51	SECTION 2. Section 42.2516, Education Code, is amended by
52	52	adding Subsection (e-1) to read as follows:
53	53	(e-1) The amount of state aid or credit to which a school
54	54	district is entitled under Section 42.2518 is in addition to the
55	55	amount of revenue to which the district is entitled under
56	56	Subsection (b).
57	57	SECTION 3. Subchapter E, Chapter 42, Education Code, is
58	58	amended by adding Section 42.2518 to read as follows:
59	59	Sec. 42.2518. ADDITIONAL STATE AID OR CREDIT AGAINST COST
60	60	OF ATTENDANCE CREDITS FOR PROFESSIONAL STAFF SALARIES. (a) A
61	61	school district, including a school district that is otherwise
62	62	ineligible for state aid under this chapter, is entitled to state
63	63	aid in an amount, as determined by the commissioner, equal to the
64	64	product of $3,000 multiplied by the number of classroom teachers,
65	65	full-time librarians, full-time counselors certified under
66	66	Subchapter B, Chapter 21, and full-time school nurses employed by
67	67	the district and entitled to a minimum salary under Section 21.402.
68	68	(b) A school district that is required to take action under
69	69	Chapter 41 to reduce its wealth per student to the equalized wealth
70	70	level is entitled to a credit, in the amount of state aid to which
71	71	the district is entitled under this section, against the total
72	72	amount required under Section 41.093 for the district to purchase
73	73	attendance credits.
74	74	(c) A determination by the commissioner under this section
75	75	is final and may not be appealed.
76	76	(d) The commissioner may adopt rules to implement this
77	77	section.
78	78	SECTION 4. This Act applies beginning with the 2009-2010
79	79	school year.
80	80	SECTION 5. This Act takes effect September 1, 2009.
