77 relating to the salary paid to certain professional employees of
88 public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.402, Education Code, is amended by
1111 amending Subsections (c) and (d) and adding Subsections (c-1) and
1212 (c-2) to read as follows:

3232 (c-1) Notwithstanding Subsection (a), for the 2009-2010
3333 school year, a classroom teacher, full-time librarian, full-time
3434 counselor certified under Subchapter B, or full-time school nurse
3535 is entitled to a monthly salary that is at least equal to the sum of:
3636 (1) the monthly salary the employee would have
3737 received for the 2009-2010 school year under the district's salary
3838 schedule for the 2008-2009 school year, if that schedule had been in
3939 effect for the 2009-2010 school year, including any local
4040 supplement and any money representing a career ladder supplement
4141 the employee would have received in the 2009-2010 school year; and
4242 (2) $300.
4343 (c-2) Subsection (c-1) and this subsection expire September
4444 1, 2010.
4545 (d) A classroom teacher, full-time librarian, full-time
4646 counselor certified under Subchapter B, or full-time school nurse
4747 employed by a school district in the 2009-2010 [2006-2007] school
4848 year is, as long as the employee is employed by the same district,
4949 entitled to a salary that is at least equal to the salary the
5050 employee received for the 2009-2010 [2006-2007] school year.
5151 SECTION 2. Section 42.2516, Education Code, is amended by
5252 adding Subsection (e-1) to read as follows:
5353 (e-1) The amount of state aid or credit to which a school
5454 district is entitled under Section 42.2518 is in addition to the
5555 amount of revenue to which the district is entitled under
5656 Subsection (b).
5757 SECTION 3. Subchapter E, Chapter 42, Education Code, is
5858 amended by adding Section 42.2518 to read as follows:
5959 Sec. 42.2518. ADDITIONAL STATE AID OR CREDIT AGAINST COST
6060 OF ATTENDANCE CREDITS FOR PROFESSIONAL STAFF SALARIES. (a) A
6161 school district, including a school district that is otherwise
6262 ineligible for state aid under this chapter, is entitled to state
6363 aid in an amount, as determined by the commissioner, equal to the
6464 product of $3,000 multiplied by the number of classroom teachers,
6565 full-time librarians, full-time counselors certified under
6666 Subchapter B, Chapter 21, and full-time school nurses employed by
6767 the district and entitled to a minimum salary under Section 21.402.
6868 (b) A school district that is required to take action under
6969 Chapter 41 to reduce its wealth per student to the equalized wealth
7070 level is entitled to a credit, in the amount of state aid to which
7171 the district is entitled under this section, against the total
7272 amount required under Section 41.093 for the district to purchase
7373 attendance credits.
7474 (c) A determination by the commissioner under this section
7575 is final and may not be appealed.
7676 (d) The commissioner may adopt rules to implement this
7777 section.
7878 SECTION 4. This Act applies beginning with the 2009-2010
7979 school year.
8080 SECTION 5. This Act takes effect September 1, 2009.
